I moved out October 15, 2007 and i don't have my birth certificate or my social security card. My dad has them still and i know he would use them to claim more money on taxes saying he is suporting me. My fiance says i should get them so he can put me on his insurence. I know my dad would never give them to me, because he wants the money. He's raising 4 kids and he loves buying new grown up toys such as new sterio, dvd's, and parts for his car. My mom in hawaii also has them, but i think their just duplicates. what do i do? I know that if my dad has my social security he can claim that he is supporting me when he isn't and get more money back. he is also getting money back from my mom. I do talk to my mom a lot, should i just reqest them from her? |

You don't need either, for your fiance to put you on his insurance. But likely, he's not going to be able to add you anyway, unless you get married.
You can get an original copy of your birth certificate by writing to the clerk of courts where you were born, with your birth name and date of birth, and whatever fee they charge - usually under $20. Then they'll mail the certified copy of your birth certificate to you.
You take your license, and the birth certificate, to the local social security office, and they'll mail you a new card.
Those two pieces of paper don't allow your dad to claim you - your age and filing status allow him to claim you. Your fiance isn't going to be able to claim you, unless you marry him.
Asking your mom for copies, also, is just fine.
These documents aren't going to DO anything for you, though. |

Go to nearest social security office and report it "Lost" and obtain a new one. Giving them your current address etc will "Flag" any mis use of your original one and they will sort it out. |

u need to go to the closest ssn office they can issue you a new one. once you get that make sure that u do your taxes before he does that is if you are workin. another thing to get a birth certificate u usually need to go to the city that u wer bor in to get it. if u wer born to far away they might make an exception and do it like that. they can. do u have a school ID because u might need that to apply for a copy pf ur ssn. even if u report it lost they are not goin to be able to do much about it. so just get new copies. congrats in takin that step to move out. decisions are hard to make but that how u learn and that is life. |

1. Who has the physical card does not affect taxes or insurance. Anyone who knows the social security number use it for taxes or insurance without the card if they can do so with the card. If your Dad claimed you in the past, then he has your number on his old returns and could continue (illegally, if he did not support you) to do so even if he gave you the card, so there is no reason to keep it.
2. You can get a duplicate social security card from any social security office; it does not even have to be the one that issued it (they are computerized).
3. The card is not needed to add you to insurance. Only the number might be. You can have your mom read the number to you over the phone; you do not need her to send the card.
4. You will need your birth certificate to get a driver's license. If you cannot get the original, you need to get a certified copy from the local government of the place where you were born; you cannot use a photocopy that you or your mother or father makes. It takes a long time to get the certified copy, so if you cannot get the original from your parents, start working on the paperwork for the certified copy now.
5. If you, your finance, or your mother files a tax returns and claims you (using your social security number, with or without the actual card), and your father also claims you (using the same social security number), the IRS computers will spot that the same person was claimed on two returns and they will do an audit. If they determine that he was not entitled to claim you, he does not get the money and he gets in trouble.
6. If he supported you from January 1 to October 14, he is most likely entitled, by law, to claim you on his 2007 taxes (the ones filed in 2008). As long as a person provides over 50% of the support for the year, they do not have to still be supporting on December 31. However, he will not be entitled to claim you on his 2008 taxes (the ones filed in 2009). |

Contact the county where you were born and request an official copy of your birth certificate. Then go to your nearest Social Security Administration office and apply for a new card. You should be able to find out how to do each via Google. |
