I was in a car accident my lawyer told me they have 100k in ins is this all i can get after 2 surg & pt ? ?
I was in a car accident my lawyer told me they have 100-300 as coverage, this is in New York state. He advised me all I can get is 100k after 2 surgeries and physical therapy for a year. The girl who hit me had a leased car does anyone know if there would be any rider attached to her car for more coverage ? Not trying to get rich here but this girl walked away without a scratch and her car was dented. Mine was totalled and I have had to spend a lot of time in recovery. Nope. 100/300 means, the most one person will be paid, by the insurance company, is $100,000. Period. You don't "rider", you "increase limits", and if they were increased, they wouldn't be 100/300.

If you don't want the 100, you can always go forth with the lawsuit, then get a judgement for more than that. Your lawyer will take his third, the insurance company will pay the 100 (which likely will go to the lawer, as his third), and you'll be stuck getting $5 a week from her forever, until the rest is paid off.

Check your own auto policy to see if you have "Underinsured Motorist Coverage". If you have, you can also collect from your own policy if the other driver did not have enough coverage to take care of your expenses and compensation. Also, check to see if you have "Medical Payments Coverage" on your policy. If so, it will also help.

There is another policy that she could possibly have, which I recommend, and that is an "Umbrella Policy". An Umbrella Policy covers liability over and above the homeowner's policy and auto policy limits.

If you had been totally and permanently disabled, would there be enough funds available for you to live on? Have you paid into Social Security long enough to be fully insured? (40 quarters, or 10 years).

After you get situated, I recommend that you see a LOCAL insurance agent to make sure your vehicle is adequately insured, to see if you qualify for an Umbrella Policy, and also to do a Financial Need Analysis (FNA) to help you determine if there is a need for life insurance, income replacement (disability income insurance), or retirement plan.

First off, $100,000/$300,000 is a lot of coverage. You should feel fortunate to have that much coverage available to you. Next, not sure about New York and its laws, but I would have your attorney investigate into the other parties need for the rental car. Their might be additional monies to be obtained if your not "made whole" from the $100,000. Also, if your not made whole, most states won't allow subrogation to take place for the medical bills. This means you won't have to pay your insurance carrier back for their expenses on the medical bills. That could end up netting you more money. Your attorney will take 25%-33% of the settlement off the top. If you have UIM (Under Insured Motorist Coverage) then I would start processing a claim with your carrier so they can begin the evaluation process. Otherwise, you might have to sue the lady and anything above the $100K would be her part, but your attorney will the charge you more (40% norm) for taking case to trial.

you will NEVER get an insurance company to pay more than the policy limits. to get any more from the person you have to sue them. Your atny is gonna take a chunk of your settlement too. IF their policy limits are not enough to pay your bills from the accident you can try your under-insured and medical coverage.

Highly doubtful you would ever get $100K and your lawyer will take at least 1/3 of any settlement you get, plus expenses. If you have to go to court, there will be court expenses too.

Your lawyer is more qualified to advise you than anyone here. He'll probably get 40-50% of whatever you recover.
