The health insurance company can "go after" your auto insurance company for reimbursement of any bills that they paid, if you purchased PIP or Medical payments coverage, up to your auto policy limit. YOU can't collect under both policies. Collecting under your HEALTH insurance automatically assigns them the right of "subrogation" - going after the other policy (either yours or the guy that caused the accident) for reimbursement. |

In MO, your insurance will pay other people's medical bills if the accident is your fault.
If the accident is someone Else's fault, their insurance will pay for your injuries.
If the accident is someone Else's fault and they don't have insurance or the insurance they carry doesn't cover your injuries, you can file under your uninsured/underinsured motorist coverage. MO does not have mandatory PIP(personal injury protection) or no-fault PIP provisions.
SO, if the accident is your fault, no medical coverage is available outside your health insurance. Also, it's not uncommon for a health insurer to pay the bills then seek reimbursement from auto insurers if there is coverage $$ available. |

I processed medical claims for over 5 years, and during that time there were occasions when the health plan paid first. However, they will expect reimbursement from the auto insurance. So, if by mistake the auto carrier sends payment to you, either forward the check on to your medical carrier, or put the money in the bank. Don't spend it because the medical carrier WILL ask for the money back at some point in the future.
Because it was an auto accident, the auto carrier has the primary liability. Your medical insurance should only be picking up anything that isn't covered under the auto policy. |
