Angel 4 now | I was injured at work, but I don't think my employer has insurance, What should I do? |
I hurt my shoulder a few weeks back. I work at a small company in Central Florida where I am the only real employee. I've worked there for 9 years and my employer has never offered health insurance or any other benefits to speak of except a decent salary. I'm not sure what to do. I've been out of work for a few days, not only because of the extreme pain in my shoulder, but also because I haven't been able to sleep because of it. I know I need to see a doctor, but I live week to week now and there is no way I could afford a medical bill, especially if it turns out to be something really serious. But.. I'm at the point I have no choice.
My real question is this.. I actually like my job and I'm good at it. If my employer does not have insurance coverage and I go to the hospital with a workman's comp claim.. What will happen? I can't afford to lose my job over this and I don't want to sue my employer of 9 years either. Any help at all would be appreciated. Additional Details I have talked to my employer.. she actually asked how it happened and I told her. She then went home and brought some home remedy heating rub for my shoulder and that was about it. She is completely aware of the problem, but seems to think it's not a big deal. I think she means well... but doesn't understand the big picture. I intend on talking to her in depth about it on Monday when I drag myself to the office. That's when I imagine things are going to get sticky. |

You can ALWAYS file a complaint with your state department of labor, that your employer won't file a workers comp claim. They are supposed to have it, AND, post notice near the timeclocko.
Unless you've seen a doctor who has told you not to go to work, that lost time DOESN'T COUNT. Yep, you're on your own, until a doctor tells you to stay home.
The hospital is going to bill you for services rendered. You'll have to pay, if there's no workers comp claim, and if you want reimbursement, you'll have to sue your employer.
I'd strongly suggest going to a regular doctor, for a fraction of the price of the emergency room, as it sounds like you're going to be paying this one out of pocket. |

According to the law no matter what in this case yr employer will be responsible cuz of the injury. U should talk to a lawyer who only deals this kinda cases. MIght get very serious . |

See any doctor you wish. In a timely manner or you could lose. Report it as a Dept of labor and Industries claim with the doctor, they should have forms for you to fill out. Don't pay upfront, wait for the outcome of the decision by your USA state governing agency.
Do a quick google search on Florida Labor and Industry dept. and read up on it. |

If you were injured at work, you should be covered under your employer's worker compensation insurance, not health insurance. Inform your employer of the injury or you will lose all claim rights. |

WHY are you asking on ANSWERS?... WHY have you not discussed this with YOUR EMPLOYER... if he refuses to do anything, then it's a whole different thing.. but apparently YOU HAVEN'T ASKED HIM.. and if it comes to going to court, YOU WILL LOSE because YOU have not taken any reasonable actions to help yourself. |
