I wrecked my Friends car & my insurance won't cover it. My freind does not want to turn into her insurance.
My insurance won't cover it. She does not want her insurance to go up. Do I have to cover the whole repair cost or just her deductable? She wants to take me to court over this. What can I do?

Offer to pay her deductible and also the difference in the premium for the next three years. She does not want to pay the increase in premium due to what you did to her vehicle but when she let you use her car she also let you use her insurance.

Offering to pay the difference may work and also salvage your friendship.

If your friend doesn't want to turn it in to her insurance, she has to SUE you in order to make you pay. If the accident was YOUR fault, then you're responsible for the whole amount, NOT just her deductible. If the accident was NOT your fault, someone ELSE caused it, then you're not going to have to pay.

First, let me say this is my personal opinion. I do not work in auto insurance.

Your friend doesn't want to claim against her insurance because it will cost her for some years in increased premium. The only thing she is guilty of is allowing you to drive her car. When you took her car, you assumed the responsibility for it, now you have to pay, and not just the deductible.

Oh, and by the way, friend or no friend, if you didn't pay me, I would take you to court, too.

her auto insurance is the primary so her insurance would cover it. if she does not have enough coverage yours would be secondary to suplement hers. she needs to turn it in to her company. if she does not want to, you need to pay for it. were the police called? if so and there is a report, she can prove she was not driving and it won't accrue any points on her license.

Your friend is certainly not acting like a friend. I assume your friend has collision coverage but does not want use her own company. Too bad! If you are driving her car with her permission then it's covered by her company. Your company would provide secondary liability coverage for physical damages you caused to other vehicles involved in the loss (it will not pay for damages to her car under either your liability or collision coverage)

She took on the risk that a claim could occur if she let anybody else use her car. Her rates probably would have gone up if she was the driver. If she was a friend she would ask you to pay the collsion deductible and leave it at that.

If she doesn't go for this, let the wench sue you and the judge will be more than happy to toss her claim out once they find out that she had collision coverage, but refuses to use it. As long as you are using the car with permission neither she nor her insurance company have the right to collect reimbursement (AKA subrogation) from you.

She allowed you to use her car. Under her policy you were a permissive driver. Her car, her insurance. It's that simple.

Auto insurance is primary on the car. So, her insurance is primary. Your auto insurance also covers you when you drive other cars. Here is the right thing to do (and I agree with the person who answered that she gave you permission to use the car, so she knew the risk in doing so): She should turn the claim into her carrier and get the car fixed. You should turn the claim into your carrier, as well. Her carrier will subrogate against your carrier and, if it is shown that you were at fault in the accident, your carrier will reimburse her carrier for the loss. They may even reimburse her deductible. You say your carrier won't cover it. You need to let the carriers go through the legalities of subrogation. If you believe your carrier is declining coverage unfairly, report them to your insurance commissioner.

It sounds like to me that it was ur fault (i might be wrong but thats the impression i got). I suggest you pay her. If she takes u to court you will have to pay her more plus the court fees (what kind of a friend is she that wants to take u to court?) If you cant afford to pay it all at once may be you ask ur "friend" if u could pay it in installment and arrange ways that ur both happy with.

Strictly speaking, the insurance follows the car and not the driver. I suppose that she can take you to court - anybody can sue anybody these days. Her insurance is primary.

What is the cost to fix it?

She can take you to court, but if she gave you the keys and said you can use it that's on her and I would assume she would lose that case and the only judgement against you will probably be the deductible.

Obviously neither of you should want it to go to the judge, figure out the cost to repair it and go from there and remain friends.

If you just want to get out of this whole thing without paying. You could try this:

Did she file a police report?
Does she have witnesses that will clarify in court that you physically borrowed her car and you physically drove it and you physically wrecked it?

If she doesn't have a police report and she doesn't have a witness, then all she can hope for is for you to tell the truth so she can collect.

This is wrong to do to a friend or someone that is close to you, so if you don't mind messing up your friendship; you could try using this strategy to get out of this mess.

If she has a police report or a witness, your screwed in court.
