The medical bills just keep growing, and I need to be reimbursed. If he doesn't have homeowners, and I sue him personally, will he be able to bankrupt and skip out? He has a house that is worth around 150K (where we live 150K gets you a nice 1500sq ft home) and several newer model cars. Also him and his wife have very good jobs. I don't know how easy it is to go bankrupt, but I am worried because I can't afford to pay for lawyers only to win and still end up with nothing. Additional Details He claims he does not have homeowner's insurance that covers personal liability. |

If he owns his home, he has homeowners insurance. That is a legal requirement, and it typically gets paid with the monthly payment. If it is not being paid with the monthly payment that means that he has at least 20% equity in the home and chose to pay it himself. However, if he was not paying the Bank would kick in their own insurance and add it to the bill.
You should be fine suing. |

He can do a chapter 13 which lets him save his house from you, and he will be able to pay between 1 and 10 percent of the total costs if anything at all. Usually court judgements are thrown out. A 13 allows the person to keep all of thier possessions and not pay very much at all. But I don't believe that you were hurt bad enough to need 150k. My husband was mulled really badly by a rotweiller and it only cost 4k. He almost died. And personally you sound like your more worried about money if the court does give you a settlement it would be for medical expenses only and they do check to see if you are just going to the doctor to get the bill to go up. You can't get pain and suffering from a dog bite anymore. If you just want the guy to lose something, you are not very nice. |

Medical Bills already at $15K ... sounds as if the dog bit your leg off.
Where are you from.... different laws apply on bankruptcy, and in some cases, a court award settlement is does not able to be included in bankruptcy (ie. they still legally we the debt).
I am guessing your medical bills are so high, because you are in America, even though this question came up under "Australia" ... In Australia you would have had free medicare (if a citizen / permanent resident).
Its sounds as if you should seek some legal advise to assess your options. |

You don't mention the police, or the pound. If you have medical bills like that they didn't come from "a bite". A dog attack would have involved a police investigation, and at least temporary seizure by the pound for rabies watch and temperament checks on the dog, followed by a court hearing on possible destruction of the dog. Without any of that, a lawsuit gets a little tough. As far as insurance goes, I don't know of anyplace he could have purchased home insurance that didn't include liability coverage. If he has a mortgage, he has to have insurance, it is part of the his agreement, and the bank would have the choice of putting insurance on it and billing him, or forclosing on the home. That being said, If you win a liability judgement, in most jurisdicitions a person can't bankrupt themselves out of it, it is not the same as a credit card debt. |

Well first of all if they have homeowner's insurance there would be no need to sue because you would have to deal with the insurance company and not the individual. However if you sue the individual you are not in any way guarateed that you will ever see a dime. Just because you receive a judgement from a court does not mean that they will pay it. There are remedies for unpaid judgements but unless they have a nice sum of money they can claim judgement proof. You can not touch their home, personal vehicles (1 per adult in the house) or land. Hopefully they have money in the bank that you can get good luck to you |

What? I think you must be looking to enrich yourself at someone else's expense. In the first place bankruptcy has nothing to do with this situation. Secondly, a simple dog bite is not going to net you anything more than your medical bills (payment). What do you mean they keep growing? What did this dog do, take off your arm, or your leg, or something? You are barking up the wrong tree so to speak. You are nuts if you think you can get this guy's house, cars, whatever. Wake up!The most you are owed is medical bills and perhaps some pain and suffering. Otherwise, I cannot believe that your medical bills are totalling in the hundreds of thousands for this incident. You sound asinine! |

If you win a judgement in a court of law, it does NOT mean you get paid right then and there. A judgement is a right to collect. If the person doesn't pay, you can apply leins against real estate and vehicles and/or garnish paycheck and freeze bank accounts.
If you put a lien against real estate, you may be able to force the sale (foreclose) of the property to collect. If they have a mortgage, then you are a second position on the property...whereby, the mortgage will be paid off first, then you get the left overs. If there is a $140K mortgage and the home sells for $150K, you only get $10K minus real estate fees/commissions.
Bankruptcy is a declaration that you can not pay your creditors and it can result in severe hardships.
I would talk to a lawyer and find the best alternative which may be a voluntary wage garnishment of a few hundred per month so that you don't cause financial wounds. The contract and filing of a garnishment should not cost that much....it's all cookie-cutter paperwork with fill in the blanks...... I would also suggest to the homeowner to get home owner's insurance to protect them in the future
