You're the landlord. You need to make sure you have a DWELLING policy in force, rather than a HOMEOWNERS, as it's no longer owner occupied.

Damages that are normal wear and tear or accidents, aren't going to be covered - that's part of the "cost of doing business".

Still, it's a really good idea to require her to get a renter's policy. The liability section on the renters policy excludes damage to locations she rents - which means your house - but at least if there's a fire, she won't be nagging YOU to pay for HER STUFF.

You may want to verify that she has a license, to cover your butt if something truly serious happens.

She needs her own insurance though, yours will not cover her business.

What kind of 'babysitter' are you talking about here? What are they renting the house for?

If you're meaning someone lives there and babysits as a job, definitely require renter's insurance. If this is a business, regardless of whether or not someone lives there, make sure they have General Liability insurance. The last thing you want is someone caring for multiple kids on your property without GL. The moment something happens to one of the kids, you'll be up to your neck in attorneys and liability as the property owner. In fact, it might not be a bad idea to get a consult with your own attorney to see if you might need additional protection from liability.

She should cover herself by getting renters insurance. You should probably require that of her. It will cover her butt if something happens, although you still may be responsible in some ways for whatever happened, which would be your homeowners insurance (although you may have to have a policy about renters in that, but I'm not sure).

If you are renting the house to her you need to be covered by a Dwelling Fire Policy with no less than $500,000 liability coverage. Since you own more than one property, you should also consider purchasing an umbrella or excess liability policy. Also in terms of your tenant under the lease you should have required for her to obtain renters insurance naming you as additional insured. In terms of her business your lease should have either excluded her running a business or if she requests and you grant her permission to run a business that it is in compliance, i.e. have a license, have all the required business insurance policies (commercial general liability insurance, workers compensation, excess liability, etc.) and that you be named as additional insured under the liability and excess policies. If one of the children your tenant is caring for were to be injured on the property, I can assure you that you will be brought into the lawsuit.

If you did not include these provisions in the lease, it will probably be difficult to require it now. Your best bet is to seek the advice of an attorney as soon as possible. Please make sure that the attorney is knowledgeable in real estate and not just a general practitioner or one of those attorneys that advertises on TV or the yellow pages. You can get a referral from your local Board of Realtors, bar association or from your local law school.
