stuttgart | If a branch from a tree in your yard falls & damages your house does it matter if it fell in a storm or not? |
This is under an average house insurance policy.
Does the health or age or species or size of the tree affect the Insurance cover? |
|

mbrcatz
|
No, the damage to your house should still be covered, subject to the deductible.
The age, health, species, size, etc, doesn't effect coverage. A falling object is a falling object - damage ANY falling object does to your house, is covered. |
|

MSAD
 |
If it is your tree and your house.....it does not really matter.
What matters is if the policy form that covers your house provides coverage for falling objects.
However, if the branch came from a dead tree--- the insurance company will probably cancel/non-renew you unless you cut the tree down. |

You do not have to prove liability against yourself to file a first party claim. Your insurance company should pay for the damage less your deductible assuming that it the cause was a covered peril.
If the branch fell and damaged somebody else's property, then they would have to prove that you were negligent. |

Most homeowner's insurance policies cover wind/storm damage and falling objects, so it would probably be covered regardless if it was during a storm or not. But your insurance company has the final word, so check with them |

Random Guy

This will depend entirely on your home insurance. Every home insurance is different and only your insurance company can tell you if they'll cover the damage for this particular accident or not. Call them and check accordingly |

You are responsible for ensuring that you have maintained the tree, lopping it and pruning if and when needed.
So you could be held responsible if the tree had been neglected age and species may determine a particular cycle of maintenance or known hazard. |
