Then works a couple of days over 60 days and has a wreck in a semi truck hauling for the company , the wreck resulted in the drivers death and was declared a no fault accident. He ,the driver had had 3 payments paid out of his pay checks . Does the policy pay double indemnity because it happened on the job , or does it even pay out at all because of the short time and so few payments were made ? |

you would have to look at the policy first and see if there is a waiting or restricted period first off. If there is no restriction on the time for a claim, then yes, the insurance policy would pay out.
As for the double indemnity...you would have to see if that is part of the policy as well. If there was not an accidental death or dismemberment clause, then there would be no added benefits, but if there is, then the policy will pay out in accordance with the terms set within the policy.
The best person to ask this question to would be the HR director at this person's place of employment. Even if they do not know the answer, they will be able to get you in contact with someone that does know, and help you get a claim started so that the benefit will pay out.

The short amount of time is irrelevant in the case you are describing, i.e. I can purchase a policy today and if I am struck by a truck next week the company must pay as long as the policy was in force. In terms of the double indemnity that would totally depend if that provision is contained in that policy, i.e. not all life insurance policies contain a double indemnity provision. The fact that the accident occurred while on the job would not be relevant.
The other point however is that the family would also be able to collect the death benefit from Workers Compensation. In addition if the accident had been declared the other driver's fault, the family would have also been able to file a lawsuit and seek a civil judgment from the other driver. For additional assistance I would advise seeking the assistance of an attorney. However, get a referral for an attorney from someone whose advice you trust or from the local bar association or law school so that you make sure you get the best available not just an attorney that announces on TV.

Whether or not it will pay an additional accidental death benefit will be defined in the plan contract. Most group insurance plans do not, but they can offer, for an additional premium, a supplemental policy that he could have attached on his own.
Even if the accident was no fault, worker's compensation may or may not pay, depending on an investigation (which most do), and they can make their own conclusion, even if a law enforcement agency/the employer said that it was a no fault accident. That just might be what it is defined as what happened on the road under the law. Make sense?
You'd have to look at his paperwork to see if he bought the double supplemental policy (if offered), and whether or not there was a first date of in force defined on his benefit plan. |

No idea. Did the policy go in force immediately? The second the policy goes in force, there's coverage. Was there a double indemnity clause on the policy? If not - no double indemnity.
Don't forget, workers compensation benefits STILL APPLY. So be sure there's a workers comp claim filed, for the lost wages for the rest of his life. |
