I am filing claims right now on the death of a parent. The insurance company would not have given her the check to her alone if you were listed as a beneficiary. She would have had to present your death certificate to get your portion. I can almost guarantee you that you were listed as a "contingent" beneficiary and that you have no claim. Drop the issue, you have no claim and all you can do is cause hard feelings. The reason I can have such confidence is a) I used to sell insurance, and b) the insurer would be liable for the mistake and insurance companies are notoriously scrupulous about such things.

If there was a policy that listed the two of you and you know none of the particulars on it, I would say it is a safe bet that your step-father intended for your mother to get the money, unless she too had passed away. While some amounts of money may seem to be life changing amounts to others it may not. While some may advise that you check in with a lawyer I would stop and think hard about it before doing so as if it is money, (and it is money), fallouts in family can last a lifetime over money and no amount should be a wedge between you and your mom. Just let it go, it was probably just enough to cover final expenses. Some of the largest family feuds happen over the littlest amouts of money. |

It would seem to me that you can contact the insurance company. If you are both beneficiaries and you are over 18, you are entitled to it. If you are under 18, then she may either get it or have to hold it in trust for you.
If you are entitled to it you may have to go to an attorney to get this resolved if the insurance company can't fix it for you. |

When you set up a policy they ask you to designate a beneficiary. You pick atleast two people. When you die the money goes to the first person listed. If that person is dead then it would go to the other person listed. You do not usually split this.
If the person has a will they may leave their assets to one or several persons. They can divide this up anyway that they like. Hope this helps. |

OK here it goes if I understand what I have read correctly, it depends on the state in most states and in federal law when it comes to benefits and insurance policies. a stepchild is a beneficiary. if you are underage generally your mother would get your benefits as your guardian. I would check my local laws and if the settlement is sizable and you are of age I would consult a lawyer. |

It depends. Some types of insurance policies list two beneficiaries. So, employer insurance might have you list your spouse first. If your spouse dies as well, then the money would go to your children. You can elect to have it evenly split between them.
Or, you could skip your spouse and have it go straight to your kids. Or have it split amongst all of them.
You'd have to know how he had his insurance policy set up. Generally, children are entitled to a portion, but I'm not sure on the law. It's definitely something you'd need to seek legal counsel on. |

If you were listed as the beneficiary then yes you are entitled to whatever portion he designated for you. However, in order for you to get the cash you must be 18 years or older. If not then it is put into a trust and once you turn 18 you can do with it as you please. Good luck and I charge 10% of the amount you receive for my services. He he he, j/k.
