Not necessarily, since some insurance companies have a reputation for stalling as long as possible before distributing monies (so they can keep earning interest on them until they absolutely must disburse them). Firms that have that kind of reputation often have legal counsel that are quite inventive in dreaming up ways to enable this - especially since this industry is not federally regulated.
