Yes the insurance company will go after he uninsured person for reimbursement of both the money the company paid and the policyholders deductible.
The process is called subrogation. I own a subrogation recovery company that handles these claims against uninsured people. Sadly, there are tons of uninsured drivers out there to keep us busy. |

Yes if the uninsured person is at fault, the insurance company will sue them. They will have many more problems than just the insurance company. They will probably lose their license and incur lots of fees.
If they are successful at recouping their money, the not at fault person will get their deductible back! |

depends on the amount of the claim and if the uninsured motorist has anything worth suing for.
That's why you pay uninsured motorist coverage in the first place. People without insurance usually don't have any money to begin with. |

No. The only way the uninsured motorist can collect from the insured's company, is if the insured is at fault for the accident.
In some states, an uninsured motorist CANNOT sue the insured, at fault person - it's called "no pay, no play". But in other states, they can.
The party at fault CANNOT recover from someone, who is NOT at fault. |
