No you can't! New York like many states is a right-to-work state. If you voluntarally quit then you do not qualify for unemployment. If your employer is at fault for your unemployment, than you would qualify, however if you terminate your relationship with your employer due to medical reasons, then you will not qualify for unemployment insurance. There are few cases that one can get unemployment if they quit (for example, if you quit your job due to unsafe working conditions that have not been addressed by your employer, than you can qualify for Unemployment).

You can request time off under the Family Medical Leave Act. You also might qualify for disability payments while you seek medical care, but disability will have to be certified by a physician and he/she must demonstrate with sufficient proof that your condition has made it difficult for you to work.

Nope! To qualify for unemployment, you have to get fired-not quit. Also, you are required to look for work while you are out. I have done it before, & if you tell them you are not actively searching, you will not get anything.

I think if you quit...you can't get it. Maybe you can at least get "leave of absence" without losing your job. Probably if you just take off or don't come back..they will fire you and you can get unemployment. (Doesn't seem right, does it !)Ask you're employer about these things...or his/her secretary or bookkeeper. Good Luck !

I handle unemployment for the employer on both sides. If you quit, you cannot draw unemployment. Also, you have to be "able", "available" and "actively seeking" employment. If you are ill enough to not work then you are too ill to be able, available and activity seeking. The State always checks out your reason for separation from employment with both the claimant and the employer. Then the state examiner makes a decision to allow or disqualify someone.

My suggestion to you would be to apply for FMLA if you qualify. It is 12 weeks long though it does not have any payments. However, you may qualify for short term disability within your company. You would not get your full wage but you might be able to get a percentage of your wage. This all depends on how long you have been working and if your doctor completes the forms to say you are not able to work. However, keep after your 12 weeks of FMLA the employer is not obligated to keep your job. If that should happen, once you become able, available and actively seeking you would qualify for unemployment.

Good luck.

No, I don't believe you could get unemployment. Typically, you can't get unemployment benefits when you quit a job, and one of the requirements for receiving unemployment benefits is that you are actively looking for another job. That wouldn't be true in your case, so I doubt you would qualify.

thylawyer
No. To get unemployment, you have to be available for work and you have to be actively looking for work.

Ask your human resources dept about the
FMLA.........Federal Medical Leave Act. this might give you enough time off work to get the treatment you need elsewhere. Sorry, I don't believe there is pay for it though.
