The insurance company is not being sued. You are.

You have to sue the negligent party - that's you. You're the one who hit another vehicle (not your insurance company).

The law suit reads Jon Doe vs. Jane Smith. NOT Jon Doe vs. XZY Insurance.

Per your auto policy - the insurance company will hire an attorney to defend you. The attorney defends YOU but the insurance company pays the bill. The insurance company gets to pick the lawyer and they will hire one that focuses on this type of defense work.

Now - you do have the right to hire an attorney of your choice to work with the insurance hired attorney - but you have to pay that bill (and it's gonna be a big one).

The insurance company will pay up to your policy limits toward the verdict - Plus any post-judgment interest and attorneys fees. IF the verdict is greater than your policy limits - you can be held responsible for that. However, unless you have assets - the plaintiff lawyer usually does not pursue you.

So...what do you do? Cooperate fully with your insurance company and the defense attorney they hired. You do what ever they need you to do or be where ever they need you to be. They will walk you through the process and answer any questions they have.

Here's the good news - lots of law suits get filed - but most do not see the inside of a court room. Usually they can be settled as the process works through or during a mediation. However, law suits are not fast things. This could go on for 2-6 years easily.

Just stay in touch with your adjuster and the defense lawyer. If you move or your phone number changes - let them know. They can and will be happy to answer any questions you have.

First, it's not your insurance company that's being sued, it's YOU!! The insurance company is simply an entity that will cover YOU if YOU'RE liable for an accident. Next, they will protect you up tp the maximum amount of coverage you purchased with your policy. So, if you have $50,000 liability limits, they will provide you a defense attorney and protect you until they see it beneficial and warrarnted to offer the $50,000. If there's a chance a court could render a judgement in excess of your policy limits, you might want to hire seperate counsel to protect your personal interests above and beyond your policy limits.

99 times out of 100, your insurance company will be able to settle the lawsuit within your limits.

If a suit is successful for more than that amount, it will be a judgement against you personally for the excess.
