depends...is the car in their name only? when my husband passed he had a truck in his name only and had bought it before we were married. the bank tried to tell me i was responsible for paying for it. i told them i was not and they better consult with their atyns. they did and i was right. i turned the truck into them and they sold it (at a loss) and wrote off the rest. it has never had an adverse affect on my credit.

They will come get the car unless someone continues the payments. They do have the title.

You need to notify the finance company of the buyer's death. They will probably come get the car and try to hold the deceased person's estate liable for the amount left after they auction the car off. This can be quite a huge amount as cars go at auction for thousands less than they are actually worth (or is owed on them). My advice would be to try to pay off the car if the person has enough life insurance or savings to do so.

They will own the car and come get it. Unless there was a life ins policy for the car.

tkquestion
If someone dies, then his/her assets needs to be closed out and distributed among the surviving members of his family. As part of this process, any debt he still owes gets paid first.

If there aren't enough to pay off the debt, if the debt was secured (for example by a car), then they take the car. If the debts wasn't secured (for example, credit cards), the debt gets written off.

The debt must be paid out of the estate's assets. If you are the executrix, consult an estate lawyer.

If the loan on the car is from a bank the bank will come and get the car and repo it....unless there is another name on the loan. If there is 2 names on the loan the survivor will be responsible for payment... if its a lease... the car will be repossessed if the lease carries 2 names the surviving person will be responsible for payment...I have worked in a bank with car loans for many years

I'm not really sure but I can't see them saying ok forget I am owed money I'll just write it off as a loss. My guess is that they will come get the car.

They should have insurance, both on the car and life insurance.. A person is never allowed to take out a loan with out proof of life insurance...
