crystal_wade06 | If someone vandalizes your car, will their insurance company pay for it? |
This guy threw something at my car, and i was able to get his license plate number. He was later arrested that night for felony vandalism, he is being charged by the state for the felony vandalism, but i was wondering if I got his insurance information, would they pay for the damages. |

No. Your insurance is primary, vandalism is covered under the comprehensive part of your policy. Part of his sentence will be restitution, that is where you and your insurance company can hope for recovery.
He was committing a crime, his insurance will definitely not pay. Sorry! |

No, his auto insurance will not cover his criminal actions. File through your insurance comprehensive coverage. |

His auto insurance is meant to protect his auto against damage, or to pay for damages he causes with his auto.
It's not an insurance policy against his criminal behavior. It won't cover what he did.
Maybe *your* insurance will. Have you talked to your agent? |

You do not need to get his insurance info.
Just call your auto insurance company and put in the claim. Your insurance company will run his license plate and send him a letter asking for his insurance info. If you have comprehensive or uninsured motorist insurance on your policy let your insurance company fix your car and go after this guy.
Your insurance company will do all the work for you. That is what you pay them for. And, this claim will not count against you. So, call your insurance company, put in the claim and let them go after this guy. And, even if this guy's auto insurance does not cover him, your insurance company will ask him to pay you out of his own pocket. Make sure to tell your insurance company about the police report, which police station or area took the report and their phone #, if you have that info.
Good Luck. |

No policy I am aware of will cover intentional acts, which is what this guy did. Your policy will cover/pay if you have comprehensive coverage and go after the guy who did the damage. |

No, his insurance would not pay. It is an intentional act. You can file a small claims action against him directly. |

No. There's an exclusion under every type of liability policy, for DELIBERATE damage. He MEANT to do it - so his coverage isn't going to pay.
You'll have to file under the comprehensive section of your car insurance, which covers vandalism - IF you bought that coverage. |

Theoretically, yes they should pay for the damages. If you did get the info and you have comprehensive coverage, the best thing for you to do would be file against that coverage (assuming the amount of damage is worthwhile to do so) and your carrier should go after the other person's insurance to recoup the amounts they paid you, including recovering your deductible. This way it wouldn't count against you. |
