If it's work related and covered by comp . . . NO ONE!! That's the trade-off - employers are off the hook, employees get absolute coverage.
Sometimes, life just happens. Pain and suffering happens. You don't get to be compensated with dollars for everything that happens to you, that's just the way life is. |

"Pain and suffering" is NOT punitive damages. They are completely different. Pain and suffering, in technical terms, is referred to as "general damages"; those hard-to-measure damages such as inconvenience, discomfort, effect on quaility of life, etc. Generally, workers' compensation is statutorily mandated by each state and usually as a threshhold or limit as well as formulas that are followed by each state's industrial commission. It can include some form of "pain and suffering", dependent on the nature of the injury. In civil cases, general damages also includes lost wages. In workers' compensation, there is a separate category for wage loss (TTD). If you're uncertain about your rights or feel as though you aren't being treated fairly by your WC carrier, you may want to consult an attorney. Be prepared to give your attorney as much as 1/3 of whatever you get from your claim, however. |

Before workers compensation the amount collected by a worker was typically small and would generally require a legal battle. Workers Compensation pays much more than the prior system and on the other hand pays a fixed amount for specific injuries. Is there some "pain and suffering" in those payments, maybe.
A good comparison is the system in the UK where they don't have workers compensation. Payment at all is less frequent and the amounts are very small compared to what is paid in the US (even adjusting for wage differences). Workers Compensation was not designed to be a "great deal" for the injured worker but to make them whole for lost wages, earning potential and specific injuries without the risk of a court case. |

First, a little history so you will understand why.
Worker's compensation insurance pays your medical bills, loss of income, and any permanent disability to you when you are injured on a job. In return for that, you give up some common law rights. Since the employer (through the work comp) is providing for the above, you give up the right to sue your employer for pain and suffering.
Now, if someone else is at fault, depending on the state you live in, you can likely present a liability claim against them for pain & suffering. Actually, the worker's compensation carrier ofttimes presents this claim, too, as they want to recover their money back if they can.
In some states, there are limitations as to who you can present a claim against for pain & suffering. EX, in the state I live in, you cannot present a claim against a "fellow employee"....and the definition of a fellow employee is pretty broad.
However, let's say you are a truck driver and you are hurt on the job by getting rearened by a dump truck. Your employer's workers comp would pay for your medical bills, loss of income, etc, and you could present a claim against the dump truck for pain & suffering.
By the way, punitive damages are not pain and suffering, but are intended to punish someone for outrageous behavior. They are not insurable. |
