Im a mechanic and if i wanted to put in for a bad back claim for workmans comp what do i gotta do?

first off you have to have an accident, and have it reported. Then go to their docter. This is the documentation part of it. Then you may get put on restrictions for working, if they decide you won't work for that postion then you can get disability.

However if you do this, you have to make abousloutly sure that you don't do anything that your restrictions say you shouldn't do. Like loading furniture, or going out dancing.

I had an employee work for me for like two years whilel sueing our company. My lawyers hired private eyes they followed him and and videoed him loading cinderblocks into his truck, dancing at the clubs. We showed the tape, case dismissed we fired him then sued him for legal costs. So you can see it isn't always the easy life.

The company you work for will provide you with a doctor -- you can't go to just any doctor. They will examine you head to toe and if they find a serious, work related injury that would cause you to not be able to do a job you will receive some form of compensation. They may also video tape you everywhere you go to find out if you are malingering and charge you with fraud if you are.

If you are legitimately hurt then you need to report it to your supervisor/manager. They will send you to a clinic or doctor's office for an evaluation and determination. W.C. wages are only 60% of your salary so you won't get rich any time soon. You can check the web site for your state to see what the benefits allowed are but it is a private insurance carrier that your company pays for the policy. If the doctor says you can work then the claim is closed. Keep in mind though, that workers comp. claims are now public records and anyone doing a background check on you can pull up a list of past claims you may have filed against previous employers.

You need to report the details of the injury to your supervisor, who has three days to notify the department of labor and insurance company. Then (like, immediately) you go to the doctor, for the exam. IF workers comp decides it's a covered loss, then they pick up the cost of the doc and any testing. If they decide it's fraudulent, or not work related, then they won't pay - either your health insurance or you personally will be responsible for the bill.

The doctors will be looking for a REAL injury, which normally will show up on MRI's or XRays. Dripping blood helps, too.

With regards to rights - if the employer carries workers comp, and the insurance company and doctor agree this is a covered loss, then they pay your medical bills, and whatever part of wages you lose if the doctor says you can't work. The insurance company can require you to see a doctor of THEIR choice, if they don't agree with your doctor's findings.

You can't sue the employer, if the employer carries comp. If the claim gets denied, you can hire a lawyer to fight it for you - if they think you have a strong case, they'll represent you for 30% of whatever they get. If they don't think you have a strong case, you'll have to pay them a retainer - usually $5,000 up front.
