You will need an attorney--you can bet whoever you are claiming was negligent will have one. This is not something you want to attempt without expertise on your side.

Depends on where you live. In Texas we have recently enacted such strict toret reform that most lawyers will not take medical malpractice suits because the potential payout is so small.
If I were you, I'd consult with a lawyer before doing anything though. Don't play your cards until you get some advice. If they won't take your case on a contingency, consider paying them by the hour to advise you (even if they don't end up representing you in court). It will be money well spent.
