Sometimes the Insurance Co. will pay Actual Cash Value for the damage that was done, then, when you have completed all repairs and have a receipt showing you paid for the work in full, you can re-submit and get the full replacement cost (minus your deductible). Call your Insurance Agent and ask him/her about the extra costs you incurred, I'm sure they would be able to help you. We do this all the time at the Agency I work for. |

If you have an Actual Cash Value (ACV) policy then that's it. If you have a Replacement Cost Policy then most companies pay the ACV until you prove repairs with receipts, contractor's bill, etc. then they will pay an additional settlement to cover the replacement cost. Your Declaration page (the one with all the coverage limits) should indicate whether or not you have Replacement Cost Coverage. |

in most cases it isn't the check that determines whether or not the claim is closed. If you have additional damage, you simply document the loss(pictures & proof of ownership(receipt) and present it to the adjustor that you have already been working with on the claim. If you have a replacement cost policy what is owed is the actual replacement cost for like kind and/or quality. |

No. Once a cheque is prepared, it simply means that it was the final computation for your claim. The moment you have received and encashed it, it signifies your conforme to the amount they have come up to. I guess it's a lesson learned.
If a similar case will happen in the future, you can ask the company to explain in details how they came up with that computation so you will have time to contest their decision. |

I am sure that once you signed for the check you got, there were some papers you signed and I am further sure that the papers you signed said something to the effect that "this is considered full payment with the amount I have received and cashing this check full fills all the obligations of this insurance company and can not be held liable for further monetary actions." Look at the documents you signed when your check was delivered or just before your check was delivered.
You may consult an attorney but I am pretty sure you have signed your rights away and by cashing the check you implied that you agreed with the amount you received.

nope, usually on the back of those check it states that by signing and depositing your are accepting the payment as full and final settlement of the claim. |

depending on the company, usually when you sign/cash the check it's a done deal. unless there's more damage done than was originally bid by the contractor OR seen by the adjustor. IE: hail damage to the decking, which is only found AFTER removing shingles |

Yes, especially if there is newly discovered damage from the prior loss, or if this is a partial payment pending replacement of the items. Usually this has to be done within a "reasonable" period of time - you won't be able to re-open a claim that's been closed for five years.
