My wife was in an acident, received hearing loss, weakness, and stiffness injuries. She can not go to movies or concerts because the noise hurts her ears. Her left side has weakenss and she can not turn her head all the way to the left. Our health insurance paid all of her claims. If we settle, will our health insurance expect to be paid from the settlement? The other person's insurance is trying to settle with us for $31,000. They have already paid for her totaled car. Does this seem fair? |

Yes, your health insurance will expect to be reimbursed. It sound to me like $31K is too little. |

To hard to tell. You did not give any diagnosed injuries. Why was there hearing loss? Weakness and stiffness "injuries" are not uncommon in an accident and would not see them worth a lot if any $. |

Yes, your health insurance will expect to be paid from that settlement amount.
Usually, a unilateral hearing loss isn't worth anything. And frankly, all the concerts she's been to could have caused or contributed to them.
Their insurance company is NEVER going to pay more than the policy limit. |

Don't settle anything until your wife is completely better! My mom went through this and after a year she was still in physical therapy. If she does not get better the best thing would probably be to get a lawyer. If she has permanent hearing loss from this accident $31,000 is not worth it. |

you won't have to pay your insurance company back out of your settlement, because the other person involved in the accident's insurance company will reimburse your i/c's claims. i hope you're consulting with some sort of attorney as far as this settlement goes.. i know it's no fun having to be affiliated with the "ambulance chaser" crowd of attorneys, but they'll get you what you deserve. |
