Hello, in the UK can anyone tell me who is typically responsible for insuring a house that is being let out to a private tenant? I know the tenant is responsible for insuring their contents but who is responsible for insuring the house itself? This is based on there being an agent managing the property. Is the agent obliged to insure the property or is it the owner?
Also does anyone know the longest time you can leave it before making a claim from the insurance? Is 2 years too long as we have been living away in America and the property was in the agents care during that time. |

It is the owners responsibility to insure their buildings. An agent is someone who acts on behalf of someone else (the principal). It would be perfectly acceptable to authorise your agent to insure the property on your behalf. Whether the agent should have done in your case depends on your agreement as to what the agent is expected to do.
An insurance policy is a contract and you have up to 6 years to start a legal claim based on a contract. However, your policy may have a shorter timescale. |

As others have quite rightly said, it is the owner of the property who is responsible for insuring the buildings.
Insurance is based upon the principle of "insurable interest", so it is only possible for you to insure and subsequently benefit from a policy convering something you have a direct financial interest in.
Therefore a tenant cannot insure a house he or she is renting, in the same way that the owner of the house would not be able to insure the tenants contents.
As regards you question about claiming, I am curious as to why you are asking. Don't forget you can only claim for damage that occured during a period when the property was insured, so if you did not have the house insured in a month when there was a storm which damaged your roof, you cannot then take a policy out in January and expect to claim for that damage. You need to bear in mind that insurers do a lot of investigation work when paying out claims and they have experts on board who will be able to advise your insurers as to when something happened, whether the damage has subsequently worsened by being left, and in fact whether you claim is valid at all.

if you are renting you only need to insure the contents. the landlord needs to have insured the house themself. this should be in the rental agreement along with details of what may happen if there is a fire or anything and the house is no longer habitable. the tennant is only responsible for contents. |
