Insurance claim question?
I turned a claim in right after Ike in the middle of September,the insurance adjuster already came by 2 months ago but yet still my insurance company has not put anything together yet.
My question is by law do they have a certain amount of time to take care of a customer's claim or can they take however long they want?
I know I should be talking to a lawyer but it's the weekend right now.

There is no law that says they have to have it "put together" in a certain amount of time.

Ike was a big storm. There are thousands of people that have damage/claims from it.

Your insurance company is not sitting around with their thumbs in their ears.....they are slammed.

The Texas windstorm association alone has received over 76,000 claims.

Most companies work the hardest hit areas first. The folks who no longer have a house come before the guy with a few shingles blown off.


But with the massive volumes of claims that are coming in, sometimes a claim will fall in between the cracks. On Monday, call your insurance company and follow up on your claim. Make sure you have your claim number when you call them.


All calling an attorney will do is bring the process to a screeching halt. It does NOT speed the process up. Not even remotely. But hey......its your choice.

This is a tricky question. If this is a claim on a homeowner's policy, there is probably not any hard and fast time limit for them to resolve your claim. That said, there are almost always guidelines established in your policy as to how your claim should be handled. Your insurance company is required to keep you advised of the status of your claim. If they have already inspected your loss, they would need to provide information telling you what remains to be done in their investigation so that your claim can be resolved. They should be sending this information to you in writing. You should check your policy for information regarding how claims will be handled. Normally, a policy will contain a section called Conditions. There should be a sub-section called something like "Our Duties After Loss" or "The Company's Duties After Loss" where the policy will outline what the insurance company needs to do in order to properly investigate and settle your claim.

The insurance companies goal is to take your premiums and avoid payout if at all possible unless the claim is legitimate.

They want to make sure that your claim is legitimate. As to the time limit to investigate and make a payout, that would depend upon your state's insurance regulations.

Is another insurance company involved (car accidents). There may be some negotiating between the insurance companies. It the claim for a reimbursement for a service rendered? There may be negotiating between the insurance company and the price the provider of the service is charging.
