someone i know received a LARGE payout from an insurance company for "permanent injuries" in an accident. It has been settled, and now he does everything, heavy lifting, recreational sports, etc. Since it is settled, as of march of this year, should i not be so upset that it looks like insurance fraud. i pay so much insurance costs that people like this just infuriate me. i was told by others who have the same opinion of him, that once it's settled the insurance company can't do anything. True? thanks for any help/opinions on this matter. |

Even though this has been settled, you could call and report this to the insurance company as an anonymous caller. It is possible that the insurance company could try to collect some back, however that is not usually possible. Despite what others say, the insurance company could have had a good idea that the person was not as disabled as was thought. Sometimes they settle because it is cheaper than litigation that could go on and on. |

Some permanent injuries are not noticeable on the outside. You didn't mention what kinds of injuries the gentleman has.
Insurance companies pay for permanent injuries only when the injuries have been confirmed by a professional physician.
When the claims are sent in with the physicians report, the insurance company's physician either accepts, rejects, or asks for more information. Sometime he will speak with the examining physician personally. When the insurance company doctor is convinced, he authorizes the claim payment.
If you were in the same circumstances as your "friend", would you want YOUR benefits taken from you?

I was considered disabled by Social Security in 2006. I was given 6-10 months to live, due to cancer. I'm told by my oncologist that there is no cure for my cancer. After 10 months of chemo, surgery and cyberknife radiation, I have no malignant tumors at this time, according to the PET/CT scans that I get every 3 months.
Although I'm still alive, and live an active lifestyle, I'm still considered disabled. The doc still says that there is no cure, that they just "turned back the clock" with the treatments and surgery.
My skin color is normal, blood count is normal. I weighed 215 lbs. before I was diagnosed. Now I way 162. By looking at me, and you didn't know me, you wouldn't know I had anything wrong with me.
Since I am prognosed as "terminally ill" my $400K life insurance policy paid the "living benefit" by paying me half of the face amount. The other $200K is currently on DWP (Disability Waiver of Premium)

Plus, if your friend received a LARGE payout, I'd be willing to bet that the insurance company did all the digging and checking before they cut a check...as a lot of them hate writing big checks.
Chances are, your acquaintance didn't defraud the insurance company. |

True. Once it's settled, it's settled. It's not fraud, if there really was an accident, and there really were injuries.
The insurance company had all access to medical records - you don't. So YOU don't know what kind of injuries there were.
Keep in mind, it's not only about injuries, but what the insurance company thinks a jury would award this guy. Juries are notoriously loose with other people's money. Any settlement for less than they think a jury would award, is actually SAVING you money. |
