Insurance query - contents /buildings?
I had quite a major fire at my house in June which effectively led to the whole house having to be redecorated and a lot of ppty damaged beyond repair. My contents insured was on the low side and the ins co are now saying we have reached our limit and they will pay no more. We had to have all of the blinds replaced they were there when we bought and were all fixed / screwed to the wall. The insurance co have put the amount against contents, I want to argue as they were fixed they must be buildings/fixtures Any ideas?
Also a large preportion of the contents claim has been taken up by "restoration"/"cleaning" costs upwards of £12000 I was never given any say in this or told the costs - we would have tried to salvage more if we knew there was to be a prob re cover. I have heard that there is an ins ombudsman decision saying we should have been given the option as to whether we wanted items restoring /cleaned given the high costs. Can anyone give me any more info? or a ref to the case?

Actually I didn't make a mistake the ins co did by keeping cover on the house I had sold. The fact that they were there when i bought the ppty does not mean I can't replace them infact the ins co have replaced them!! They cant be easily removed they are fixed to the walls no doubt why the last owner had to leave them!!

Insure through the Halifax.
They limit how much they pay out on high risk items but for everything else, they do unlimited.
They cost more but they pay out more as well.
Your insurance company didn't give you any options about restoration or anything like that. They cover repair or replace, and if there was anything that you didn't want to be considered as part of your claim, it is your obligation to make them aware of it, so the short and simple answer is sorry, but you under-insured yourself and they are within the rights to stop paying when you reach your limits.
The fact that they have paid out to the limit is surprising, as under-insurance normally deducts from payouts. If you insure only 80% of your contents, your insurance company will normally only pay out for 80% of the limit you have specified.

Buildings is classed as something you can not take with you when you move house. As the blinds can be removed they are classed as contents. Contents is anything you can take with you when you move home.
As for the cleaning choice - no you do not have that option as your insurance company controls the claim. they may ask you but they can insist on any number of events to take place to put you back in the position you had been before the fire.
You would have to go through the Insurance company's complaint procedures before the Ombudsman would assist you. Check you policy booklet it will give a definition of what is what. In short you have found out why you should ensure you are insured to an adequate sum!

I am sorry but blinds are classed as contents as they can be removed by taking off fittings - unfortunately a lot of people do not know that each year you should increase your contents/buildings cover on insurance - the only reason I knew I should do this is because at one time I worked for insurance loss adjusters and I saw claims denied for not enough insurance etc - I also found out exactly what my insurance covered and took out the best insurance after that so I would be covered for losing items outside the home, breakages/accidents to contents in the home etc - it is only a few pounds more but can save you a lot of money in the long run (ie I lost a stone from an engagement ring and I was covered by loss outside the home and the insurance paid for the diamond to be replaced no problem) The best thing to do is go into the internet and get quotes from at least 5 insurance companies for full cover - always add on the value so that you are covered to the max

You can go to the Insurance Ombudsman - you will find them on the net but I doubt that they will be able to help you in this instance - sorry

Blinds cannot come under your buildings insurance as they can be removed and replaced easily. In any case, you didn't buy them, they were already in situ.
This is a classic case of complaining because YOU made a mistake in not getting proper insurance cover.
The insurance company is perfectly within their rights to say enough is enough.

It is possible to claim that blinds & fittings are part of the building and therefore covered by buildings insurance. It depends on how they are fixed. The starting point for claims is the thought "if I was able to turn the house upside down what would fall to the ceiling". If the item would fall then its contents; stays in place then it is buildings. However I personally think your chances of claiming on the blinds are slim. It is probably not worth the bother to claim for the fittings because the time you would waste in pursuing the claim would be less than would be paid out. Cleaning costs are interesting but again I think you are wasting your time. How are you going to prove that £12,000 was or was not reasonable. If you ever have a major claim in the future get your own assessor - even if you have to borrow the money to do so. Then the discussion becomes assessor to assessor.

Insurance Ombudsman decisions do not form a precedent.

If you feel you have been unfairly treated, write to the insurance company, head your letter "COMPLIANT" and set out all the circumstances and what you want them to do about it. This will trigger the complaints procedure and get someone other than the claims department to look at it. If they don't agree with you, they will send you an Ombudsman form. The Ombudsman service is currently being quite tough on insurance companies who offer low premiums and then try to wriggle out of household claims.
