My health insurance company sent a check to me for the amount of the my hospital bill (well some of it) for when I had my daughter. My husband and I needed extra money so we used some of it for other stuff that we needed (I wasn't working and he was laid of off work) and we were just going to pay the monthly to the hospital for the bill instead of using all of the check from them. well now, they are asking for the money back 5 months later, because they billed it wrong. will I get in trouble for spending the money?? or can we pay them back monthly.. they shouldn't have sent the check to me, but to the hospital, so now they are reprocessing it.

not like i used it for clothes or trips, i used the money for food, rent, gas, NESSECITIES, and i know i got myself into this, but I am just wondering what my options are.. no need to be rude. |

You will have to call them and work it out.
You do realize that this whole problem would have been avoided if you had sent the money to the hospital -- since that's WHAT IT WAS INTENDED FOR - you knew that is what that money was intended for.
Sorry....no one to blame but yourself. Your poor choice - to use the money for something other than it's intended purpose - got you into this.
However, you will have to pay all of it back or they will sue you.
You will have to ask them if they will accept payments. |

i work a lot with recoupement of funds paid in error...
most insurance companies will not set up a payment plan for you to send it back... they will send you to collections, and depending on how much money we are talking, sue you.
you wont get "in trouble" for spending the money, as there is nothing that binds you to endorsing the check over to the provider.
in the future, dont do this.. this is a bad habit to fall into. |

If you were in a financial bind then you should have applied for some state or federal assistance. You knew this money was for the hospital and you COMMITTED FRAUD by taking money tht you knew was not intended for you.
You need to go work it out NOW. Don't wait for them to ome after you.. They will sue you. You have a shot at some type of possible payment arrangement if you go to them... maybe, but don't drag it.
And DON'T do it again. It's a bad habit to get in to. This is how people get into credit problems with credit cards. |

Well, they probably just aren't going to pay the hospital until/unless you pay them back - in full. They'll probably tell the hospital they sent the money to you, and the hospital will put you through collections to get the money. They don't HAVE to offer you a payment plan - but they usually will, as long as you can pay it off within a year. It's easier and cheaper for them to take a reasonable monthly payment, than to take you to court and garnish your wages. |

Neither the insurer nor the hospital is obligated to give you a payment plan in this situation, since the money was given to you in one lump sum.
You can try to work out a payment plan - if you're lucky they will offer one to you. However, the most likely scenario is that you'll find yourself in court over this, and a judge won't look too kindly on the situation.
Next time you find yourself in such dire circumstances to the point where you can't pay rent or buy food, perhaps you should apply for public assistance before resorting to stealing from the hospital. (That's what your actions amounted to - stealing. Not saying that to be rude, just pointing out that's what you did by not signing over the money to the hospital for its intended purpose.)
Apparently fraud is your specialty...aren't you the one who transferred your car into your brother's (brother-in-law?) name, hoping to avoid having to reveal it as an asset in a bankruptcy? (Even though that's just as illegal and fraudulent as your insurance issue.) Hopefully you're trying to raise your daughter not to be a deadbeat...just remember, kids learn from what they see every day in their household. Try to show some more responsibility at least for her sake. |
