Insurance refusing to pay?
I got into an accident a month ago and got the police report which indicated that it was the other parties fault. Now the insurance company of the person who hit me is refusing to pay and says its 50-50. Please what can i do, i need my car fixed

Not sure what some of the other answerers do for a living but I doubt they are claim adjusters, who deal with this kind of stuff all day, every day.

First off, the police don't determine fault. The Police report is just a recap of what happened.

You don't say whether you have collision coverage, but if you do you should use it and make the claim to your own company. Your company will then settle with the other company and get back at least 50% of your deductible.

You did not provide any accident details so I can't give you any idea if the accident really is a 50/50. Most states have comparative negligence laws which allows both drivers to be held partially at fault for an accident. In many accidents the person who is at-fault is not 100% at-fault.

If you do not have collision coverage then you have to negotiate with them or file a small claims lawsuit against the other driver, NOT the insurance company.

Hiring a lawyer is a waste of time and money. Most don't know or care about disputed liability cases. They just like the big injury cases.

Get on with YOUR insurance company and let them know that's what you have been paying premiums for...tell them to do their job. Oh and don't just work with your agent, if you are in the right contact the CEO or legal council....they will help you.

see your own insurance company they should fight your case for you.give them the police report and all your details you shouldnt have any probs.the other persons insurance com is trying to get out scot free but with the police report favering you they havent got a chance.good luck.

First, I would approach my own insurance company with the dilemma. BELIEVE me! your insurance company will be the first ones to start fighting this, as they do not want to pay the money. This other company is just trying to get out of it. If you live in a no-fault state, this may cause some problems, but that police report is the thing that will save you.

Make a big stink about it. Tell the other party's insurance company that you intend to tell the local news what a cheap company they are, and how they do not cover their drivers properly. Make their life a pain so that they cave in.

Submit this to your agent. When they pay you then your ins. company subrogates against the offending persons ins. co. to get their costs back. All insurance companies have their own lawyers to handle these things.

Some states have an insurance law call comparitive negligence others is contributory negligence.

Under comparitve negligence fault is split based on your part or amount of fault in the accident.
Under contributory negligence(VA DC NC MD) if you contribute you are accountable.

So if you contributed at all your insurance will have to pay for your vehicle the other person insurance will pay for theirs. Do you have Collision?

That's the game. Now it's your turn to up the ante. Get an attorney to write them a letter and see what the next offer is. The letter will cost a couple hundred, but it may just turn the tide.

Suing them probably won't get you a bunch extra, especially when the attorney needs to be paid.

Continue follow up the case and ask /complete for the requirements then submit it in black and white. follow up for three times in black and white. if no reply from insurance, consult an attorney and present your three request.

Hire an attorney to pursue the matter. Your insurance company may also hire a lawyer on your behalf if they feel it is a compelling enough case. DO NOT GIVE ANY INFORMATION TO THE OTHER PERSON'S INSURANCE. Especially if you are filing suit. let them find out about it in discovery.

You can tell their insurance company that you dispute that. They will most likely review it and may place blame differently. If that doesn't work I would consult an attorney. Good luck!
