Who gets the insurance check: my son, myself, of split it?
I bought my 17 yr old son a great used car, which his step-brother smashed into. This is the third used car I've bought my son. The neighbor smashed into the first one while parked. The second one died soon after it was purchased.
I'm a single parent and disabled, so it's very helpful for my son to get around on his own. His dad doesn't help much.
We really wanted to keep the car, though we have to get a salvage title, which will make it difficult to ever sell.
The only other choice was to give it up to the ins.co. and try to find another really good used car for little money.
We chose to keep the car and the insurance co. paid us a lot more than we thought. I bought the car and it's in my name. I had been thinking about changing it into my son's since he turned 18.
My son did have the oil changed, put a new tire on, and paid $500 recently to have a brake job on the car, so he did keep it up some.
What's fair? |

The check will be made payable to the person on the title of the vehicle and any lienholders.
If you want to give the money to your son, that has nothing to do with the insurance company, and really can't be answered by anyone who doesn't know the situation between the two of you. |

You bought the car and then it was wrecked. You used the money to pay off the car and have now given it to him. He still has his car with the brake job so I don't believe you "owe" him anything for it. Other than the brake job, he has put no money into it above and beyond normal maintenance (oil change and a tire). If I were you, I would keep the remainder of the money to continue paying for the expenses you incur in raising him. |

The person who OWNS the car legally, gets the check. Whose name is on the title?
Personally, there's NO WAY I'd just "hand" a car over to my son. Keep in mind, once you do, it's HIS, he can do whatever he wants with it, even pawn it for cash.
*I* would make my kid buy it off of me. Give him a GREAT price, but still. |

For me, the money should go to the person who is paying the car and who put the down payment on it and who legally owns it. The person driving it, if he is hurt during the accident will be compensated differently and if all the medical claim has settled already. But worse comes to worse - a small claim court should decide.
But you son also have to be compensated because he put some of his money into it. This matter should not be a big problem since you guys are family.. |
