Insurance settlements, and how much do I ask for??? help!!!?
It is manditory for me to see my chiropractor 3 times a week, for 12 weeks until my spine is better. He said he is considering my injury a spinal dislocation of some kind. I am now ready to negotiate a settlement with his insurance company, and he has USAA military insurance. I know the damage to my car was $2,300... and with all the medical bills combined its up to about $3,000+ now. I dont know how much to ask for as a settlement. It always amazes me that chiros treat soft tissue injuries for about the same length of time that it takes for those types of injuries to heal without any treatment. But that is another topic.

You have two issues here: whether to hire a lawyer, and how much to demand for your settlement. Most claims are settled out of court. As such, you can do so with or without an attorney. Remember, the money to pay the attorney comes out of your settlement. The insurance company doesn't pay for them. Whether to hire one or not mainly depends on how comfortable you are with negotiations in business matters. If you feel ok with it, you can do it yourself.

Next, how much to ask for. The biggest load of crap I hear is that you get three times your bills. WRONG!!! Your doctor might run a bunch of test, or send you to unnecessary treatments (yes, doctors are in it for money too). In those cases, the insurance company might not even pay for those bills. Another comment said you should ask for policy limits. WRONG AGAIN!!! The company won't even provide you with a counter offer on such a ridiculous demand. You have a minor loss, which is very doubtful a policy limits case.

So, what should you ask for. How much are your reasonable medical bills? Have you lost any wages because you were off work due to the injury? (You will need proof from your doctor and employer.) What type of injury did you have? Is it a soft tissue injury that would heal over a period of a few weeks without any further problems, or will you have ongoing medical problems? These are the questions you will need to answer. Gather this information, along with medical reports to support your treatment, and then ask yourself what you think is fair. Write it up and send the information off to USAA. And be prepared to justify your demand. They aren't going to give you big bucks just because you want them, or threaten them with a lawyer/lawsuit. (I preferred dealing with lawyers. They knew how do prepare this stuff and I had to spend less time babysitting claimants.)

I hate it how people asume you should get enormous amounts of money when you're involved in an ACCIDENT. It's called an ACCIDENT for a reason. In my opinion, as long as they get your vehicle back to pre-loss condition, pay for your med bills, and give you some money for the inconvenience, what more do you need?? As long as your back to good health once your treatment is finished, why would you want to milk a huge settlement because someone goofed? It was a mistake!!

Injury attorneys are part of the reason our insurance premiums are skyrocketing every year. They drag out the settlement proceedings costing the insurance companies more for salaries to maintain the file and for attorney's fees to represent their insured.

Very few companies out there will try to take advantage of people simply because they can. The problem is, the only ones you hear about from the media are the times that someone gets screwed. You'll never hear about the millions of people every year that get treated very well by an insurance company.

Nicely put Phil. My two cents, if you are still treating, you should not be settling your claim. If the meds are reasonable they will be included in the settlement. The insurance company will not formula price. The value of your claim varies from state to state. In MA, it would probably be worth about $3000(w/o meds since MA has PIP Coverage), in CT about $3700 and in NYC about $4800(just to get rid of it since you did not sustain a "serious" injury).

Wait till they make an offer. If it sounds good, take it. If it sounds like not enough, negotiate for more. If they say no, get a lawyer. Personal injuries are something insurance companies want to settle quickly. They will probably make you a good offer. They are a great company btw. Good luck.

The basic settlements I've seen in my spotty experience with litigation are usually three times the cost of the medical.

Hire the attorney. If you are not smart enough to do this then ask USAA in WRITING to produce their insureds policy for your review. Then in WRITING ask for the policy limits. As with most insureds they do not carry enough insurance to cover a victims medical expenses. Most people are too cheap and do not understand the price of accidents.
