Joe | Insurance won't replace windows...is this right? |
I just comletely remodeled an older home (including refinishing the windows and original trim) and it has the old windows with divided glass. Unfortunately we had hail a week ago and it broke out 7 windows. The insurance company says they will only cover the cost to replace the glass squares because they are fixable. On most of the windows multiple squares are broken.. 5, 6, 7. Is this right? Can they do this? The rain and wet also stained and raised the grain on the inside of the windows, but they say this is fixable too. Why do I even bother having insurance? Additional Details I'm not talking about an upgrade mbrkatz.. insurance agent 21 years... I'm talking about fixing the windows I had completely stripped, stained and sealed less then 2 months ago that were wer for 8 hours while I was gone at work and ran down the inside of the window, down the wall and soaked into the sheetrock. |

There are tons of reasons to have insurance. Try having a house fire without insurance and you'll change your tune.
The insurance policy is a legally binding contract that is approved by your state. Every little word, clause, exclusion is approved by the state. one of the clauses states that it is up to the company to decide if items are to be replaced or repaired. Of course, you can have some input into this but the final decision rests with the company.
I do agree that they should send somebody out to inspect the damages. However, more and more companies are trying to save expense money.
I'm also wondering if it wouldn't be better to keep the original windows as far as the value or "curb appeal" of the home.
If you really, think they should be replaced and you have an estimate or report from expert repair person, I would suggest that you contact the company supervisor. Ask them to send a field adjuster out to inspect the damages to verify the experts opinion. Without the experts written opinion you don't stand a chance.

Well, they don't upgrade you to fancy replacement windows. If you had old panes with glass, that's what they'll replace. And those glass panes are CHEAP to replace, likely only under your deductible.
They don't UPGRADE you! ! It's not an UPGRADE policy! It's REPLACE what you have.
And if it only rained inside one day or so, then sure, that's fixable.
You bother having insurance, because your mortgage requires it. Or in case your house burns down. NOT to upgrade, or maintain your house. A policy that covered maintenance and upgrades would cost like health insurance - 10X as much. |

Sorry to hear about your home owner woes.
Just make sure that the repairs are completed to your satisfaction and try not to get all worked up about it. There are plenty of other things in life to get worked up about. |

Insurance companies will repair damage until it is cost prohibitive and the better answer is to replace. If there is some damage companies will repair with like kind like quality materials. If it is more feesible and cost effective to replace the insurance company has that option. Talk with your agent and let him or her know your fustration and they may be able to work with the adjuster to help you understand the position fo the insurance company or if there are other options to remedy your loss. What would you have them do? Completely upgrade all your windows in the entire house? Insurance only replaces in kind that which was damaged. |

Hi Joe...
Sorry to here about your window problems but I'll have to agree with the agent of "21 Plus Years"...
Insurance is very much a "rip-off" that is backed by the government... Something to which all of us have to have... Be it home owners, automobile, life etc...
I believe if one goes back in history... Insurance derived from the old day's of the early 1900's or before when there was organized crime and store owners had to make payments to "mobsters" or suffer having there establishment burned down.
Anyhow!!!
