My mom has worked with the same company for years - Her health insurance is Blue Cross blue Shield. She has been with her boyfriend for about 8yrs. Not sure when but he has been on her insurance and has had operations, ect. Recently her insurance is asking for a marriage lisence. They arent legally married. So now she said they may go get a marriage lisence. So he can continue to be on ins. We dont want her to get this done and legally married to him. She thinks its just paper anyways. But my sister and I both live out of state with our familes, and hopefully they will move too. But we are looking into this for her. How could he have already been on her ins without a marriage lisence. Can he be on her ins with just being her boyfriend - Since she does pay for it. If for some reaosn she does get marriage lisence wont they see the recent date and back charge them for the ins he did use that wasnt married then. Any input! Thank You |

Most states require that you be married.
That is probably how it works in your mother's state -- since the health ins is asking for proof of marriage. And the marriage license will have a date on it.
Just because they are married now--- does not make them married at the time of the treatment so the health insurance company may come back after them anyway. There is a very good possibility that this scheme will not work.
Remember... you can't buy life insurance for someone after they are dead....... you can't purchase car insurance after you wrecked the car........so I doubt you can get married after the fact to get health insurance. Insurance requires that you be covered...BEFORE the event,
A marriage license may just be "a piece of paper" but to the insurance company it's a piece of paper that means they may have paid out thousands of dollars for medical bills they did not owe. It's a very important "piece of paper" to them.
What your mother and her boyfriend did....has a name. It's insurance fraud. Most likely the represented to the health insurance company that they were married in order to get him covered. If I were your mother, I'd call my HR rep at work-- not run out and get married. Explain the situation to them and see what they advise. The HR person will know the health plan and if it requires a marriage license and if getting a marriage license after the fact makes a difference.
If your mother still insists on getting married -- how about having her and the boyfriend sign a pre-nup. Make sure it details that he will be responsible for those medical bills in the even of a divorce. After all.....that's just a piece of paper too. |

Problem - she's been committing insurance fraud all these years. She told them they were married. They're going to come after her for payment for all those services. Yes, they require them to be married, otherwise they wouldn't be asking for proof.
She's going to be getting some MASSIVE bills. Marrying him now isn't going to fix this problem. |

Your mom has been committing insurance fraud and is finally getting called out on it.
Employers are increasingly conducting audits of dependent eligibility to make sure that employees aren't defrauding them by claiming people they shouldn't be. In the past, employers often took new employees at their word when filling out insurance paperwork - now, documentation is being requested.
Your mom needs to fess up to her employer. As you pointed out, if she gets married now, they will see the recent date on her marriage certificate anyhow. There's no hiding the fact that she has been claiming a "spouse" who wasn't legally her spouse.
Best case scenario? Your mom's employer offers an amnesty provision, where they just remove all of their employees ineligible dependents going forward and don't penalize them for the past fraud. In that case, your mom wouldn't be penalized, but her boyfriend would be dropped from the insurance.
Worst case scenarios? Well, she could lose her job. She could be liable for all of his past medical bills. They could prosecute her for insurance fraud.
Only way she can know what's going to happen is if she sits down and discusses her options with her employer. It will be a tough conversation, but unfortunately her dishonesty is what put her in this position. Now its time to face the repercussions of her actions. |

Common law marriage is a highly technical subject, that depends on a lot of factors, and just saying you are, does not make it so. See a lawyer regarding that.
I suspect your mother listed her boyfriend as her husband on the application, and now the insurance company is asking for proof. What else would trigger the question? |

depending on the state they can claim common law marriage.
If your state is not one of them she is screwed for insurance fraud. |

If the state they live in allows for Domestic Partners (like California does), you should look into that and see if it is a better alternative. |
