Your question is regarding the 'loss of use' of your vehicle. The insurance company for the person at fault is responsible to reimburse you for the loss of use of your vehicle. This can either be through reimbursing you for the cost of the rental vehicle, or a cash payment. Contact the adjuster and advise them that they are responsible for the 'loss of use' of your vehicle, and that if they don't provide this, you are not going to release their insured from this claim.

There is no law that I know of that requires an insurer or the at-fault driver to provide a rental vehicle up front. They can be required to reimburse you for reasonable rental expense as part of your claim when you're ready to settle, since this is a natural consequence of the loss and you need to get to work to avoid losing income. Some insurance companies, as a courtesy, will provide for a rental vehicle and will even set up direct bill, but that isn't a legal requirement. Also, if you don't meet a rental agency's age or insurance requirements--or you aren't willing to provide the car rental agency with a charge card or security payment--and they refuse to rent to you, the insurer is not required to produce a vehicle for you to drive, either. All you can do is save your receipts for the rental you paid for yourself or whatever public transportation or taxi service you had to use and turn them in for reimbursement as part of your claim.

since this was their fault they should be paying for your rental. if this was your insurance paying then you must have a rider for a rental on your policy. talk to your insurance agent about their policy paying for your rental.

Unfortunately, unless you have rental coverage on your policy you are stuck without a car. The insurance company is only responsible for providing the coverages that you pay for on your policy. There insurance company pays for their vehicle to be fixed and a rental for them if they have the coverage on their policy. The loophole maybe that you could pay for the rental and file a civil claim for the out of pocket expenses incurred as the result of the loss but you woud probably spend more in court costs than rental fees for filing the suit if the damage to your car was minimal but it is an avenue worth pondering if you are going to be without a car for awhile.

They are required to supply you with a rental but ONLY the rental. If you need to put a deposit down or are required to take out the rental companies insurance you are responsible for that. Also if the repairs are to take 2 days you can not take car in on a Friday and pick it up on Monday. They only owe for 2 days of rental.

Well that depends on if car rentals was part of the policy that the truck had. You should get your agent to contact them, because it is your agents job to represent you.

OK, then you need to sue the furniture truck people and the driver of the truck in small claims court for the cost of the rental.

MOST of the time, if they're paying for the car, they're at fault, and they'll lose, so they volunteer to pay.

But they don't HAVE to pay ANYTHING until after a judge says they do.

Be sure to ask for court costs as well.

If your insurance has rental coverage then your insurance will pay for a rental...the person who hit you is not responsible to pay for the rental, only the damage to your vehicle (and that is only if you live in a fault state...as opposed to a no-fault state, like Michigan).

I suppose that depends on the insurance policy of the furniture truck. I've been in the truck's situation, and no, neither I nor my insurance have to pay for rent of a replacement car while the damaged car was being repaired. Sorry.
