Is it fraud if I had my car damaged by someone else and they want to pay out of pocket for it, and I get an estimate and they pay me, but I don't get it fixed. Is that considered fraud? |

by insurance law, you need to report any accidents which happen with your car small, big, your fault, someone else fault, to insurance company. but small accidents 90% percent people don't report. Some times it is not worth it, due to having big deductable. i will not call this situation fraud. you just will not comply with policy |

No, if someone damages your property, it's only right they pay you back. And if they decide NOT to go through their insurance agency, it's their fault if they overpay you. It's not fraud. What you decide to do with the money from there is your business. But if you decide after you get the money from them to collect for damages elsewhere, (ie your insurance company, their insurance company, etc) then it may be fraud. |

no more so than if you get in an accident it is reported insurance pays you directly because you own your car outright and you choose not to have it fixed. Not fraud. But don't turn around and claim that damage later against insurance that would be fraud. |

Nope. Fraud is when you put the claim in a second time. |

Not fraud until you report the claim and try to double collect. You don't have to get your car repaired after an accident or hail storm either from your insurance company but then they aren't liable to repair that portion of your car again. Just be careful that you don't fall into that trap. |

No, because your car is devalued by at least that much.
However, I would encourage you to get it fixed.
First, if you have a loan on your car, that can cause you to have negative equity.
Second, it's just flat out rednecked to drive around a damaged car. |
