No, insurance contracts state that they pay you money based on the damage done to your vehicle. So if you get an estimate and they send you a check for that amount, it's up to you what to do with it. Most insurance companies will pay repair shops directly just to eliminate you as the "middle man", but you don't have to.

"Fraud" implies that there was an intent to deceive for personal gain. A few examples of fraud would be claiming money for an accident that never happened, presenting an estimate to the insurance company that is actually more than the bill would really be, or claiming damage under someone else's insurance (so your rates won't go up, or because you can't pay the bill yourself, or something similar).

no it is not. someone crashed into my car, totaling it. i got the current blue book value for it, and scrapped it. kept the money. its your money, who cares if you decide to put it BACK into your car or not. its not the insurance companies concern.

Fraud is getting the money by devious, dishonest means.

No. The money is purely to compensate you for the loss so if you can get the insurance company to give you money instead of paying for a repair then it's up to you what you do with it, but obviously your car will still be broken.

No. If you have a loan out on the car though you may be obligated to have it repaired.

You can keep the money. Fraud comes into the picture when you have the next accident and claim for the damages you never had repaired. Then, they will fix you.
