Is it legal for a car dealership to charge a salesperson for a customer's bounced check?
My mother is an assistant for the top-selling sales person at a local car dealership. It is a reputable dealership, and is one of the largest in the area. A customer of theirs had written a $1500 check (i'm assuming down payment). They were financed and were allowed to take the vehicle home. The check ended up being returned for non-sufficient funds, and the dealership took it out of the salespersons pay. They recieved a memo several months ago stating such penalties, but is this legal? What kind of action should be taken? I would appreciate any and all comments. Thank you.

If the salesperson was informed of the policy (regardless of what you think of the policy) in advance, then it is legal for the dealership to do what it has done. My guess is that they are putting the onus of collecting the check onto the salesperson.

Have your mother tell the salesperson to contact the party at fault and start putting heat on them, including indications of legal action if they do not perform and make good on the check. It might also be possible to inform the finance company of the situation, but that should be checked for legal clearance.

The salesperson should call the customer and tell him/her that if the check isn't picked up with cash, it will be turned over to the County Sheriff's Dept. I believe that a NSF check of that amount is a felony.

The dealer is a scam. Call your local DA and they will help recover the funds. Some states it is up to 3 times the amount of the check. I have had checks bounced in Florida and I used the local State Attorney to help me. It worked 100% of the time.

It's not ILLEGAL! If the salesperson doesn't want to guarantee the check, he needs to either verify funds with the bank, or ask for a certified check or money order.

Well, when a prior written warning was issued, then it is company policy. It may be unusual, but that is the policy. No business gives assets away without ensuring payment secured and verified.
