Is it right to take a week off my vacations after I got injured at work ?
I got injured at work,so they sended me home for 1 week, now they want to pay me that week and take one of the 2 weeks vacation that I get at year. I use my 2 weeks of vacation to go to my country and visit my family, so i declined the offer, but my boss claims that I have to accept it...I don't want the money, I'm just interested on getting the other week that I need as I said before to see my family, is there anybody who can help me figure out this dilema...Please...

NO you need a lawyer. Or you can go back to your doctor get a statement saying a week off and then file for workers comp.

You need to talk to a lawyer. If you got injured at work you might be eligible for workers comp. It definitely shouldn't come out of your vacation time.

This definately sounds like a workers compensation claim. When you got injured at work did you go to the Human Resources department and speak to them? They should've filed a worker's compensation claim as well as send you to a doctor for evaluation (whether it is a work comp doctor or your own personal doctor). If you did all this, I would go back to the HR department and find out what is going on and get this resolved as you should not have to use your vacation for a work related injury.

If the HR department does not get this resolved I would contact a workers compensation lawyer and have them deal with this.

You might also go onto www.allexperts.com and find a work comp lawyer and ask for some advise as everyone who offers their services on www.allexperts.com do not charge a fee online.

Tell your boss that you will speak to a lawyer about this issue if he will not work with you to resolve this. You boss sounds like a stupid man, but he isn't that dumb to get lawyers invovled ina minor argument.

If you were truly injured at work, you ARE entitled to worker's comp (if you work full time at that job) and there is NO WAY your boss can take away vacation time from you because of this injury.

I agree, this sounds like Workman's Comp. They should have to pay you, although WC is only about 66% of your normal wages.

There are two answers to you question.

1) Is it right morally? A: This depends on how good a worker you are.

2) Is it right legally? This depends on what country you live in. If you live in the UK you could try calling the citizens advice bureau, they will tell you. If you work full time and you are in the UK then you are almost certainly not getting your legal holiday entitlement...you should be getting more than two weeks holiday!

follow your chain of command. if you are unable to resolve this issue with your boss, go to his and so on and so forth. check into workers compensnation benefits in the mean time and if you are unable to resove the issue with the company entirely then you should contact an attorney so resolve it for you. You can also contact the labor boards in your state for information. There is a time limit in filing for workers compensation so get on it asap!
