Is it true that if I'm on workers comp I can not touch my 401?
I was told that I could not take any money out from my 401 untill I came back to work. I just had surgery for the second time, and I dont think I'll be going back to work any time soon. The doctor is considering putting me on disability.

Being on Workers Comp alone is usually not an allowed reason to take withdrawals from a 401(k) plan. Plan withdrawals are usually limited to specific occurrences: i.e. retirement, hardships (buying a house), and disability are common ones.

Your plan document must define what "disability" is. It may state that disability is defined as Social Security defines it, but you need to check it. You will also need to be sure that being categorized as 'on disability' is the same as your Plan's definition of "disability".

Lastly, your plan may 'exclude' employees on Workers Comp from the 'eligible class' since you would not be able to fund contributions to the Plan while you are not working.

Once you either return to work (become 'eligible' again) or meet the Plan definition of "disability", then I believe that your company is correct in disallowing a withdrawal.

You cannot withdraw any money from your 401(k) until you terminate your employment with the company. You can, however, borrow from your 401(k), although since the repayment of the loan is typically done through payroll deductions, they probably won't let you borrow from it until you return to work.

If you are not going back to work, roll the money over into an IRA.

You can let it sit or begin withdrawals without penalty if you are permanently disabled.
