Is life insurance covered under COBRA?
Life Insurance is an employee benefit available to all workers. Life insurance company refuses to pay on claim because they say that we, the employer, never made it part of our contract. Isn't COBRA a federal requirement?
Thanks

OK, COBRA is a Federal law. It does not vary by state. Federal law always supersedes state laws. That being said, any benefit you have because of your job has to have COBRA continuation benefits if you have 20 or more employees. I have never come across anyone that wanted to COBRA their life insurance, but I would check with an outfit like www.ceridian.com. That's all they do is administer COBRA. Most of the time, life insurance is portable meaning you can continue the coverage usually at the same cost as it had on the group. I have dealt with COBRA for over 23 years, and learn something new all the time. For example, if you have voluntary dental because of your job (you pay all the cost) and leave your job, the employer better offer you COBRA for it because that was a benefit you had because of employment. Even though the employer did not pay for it for you. Every meeting I have been to regarding COBRA makes me glad it is an employer law not an insurance law! Be very careful - you as the employer may end up being personally liable for the life amount if you did not send a COBRA notice. I highly suggest you pay a company to administer your COBRA needs for you that also assumes the liability for COBRA and HIPAA. The fines for being out of compliance are very high, and the IRS can audit you for COBRA issues, too.

Life insurance is covered under Minnesota's COBRA requirements. The company must be in Minnesota.

.
No, unless the contract says it was "portable."

COBRA is for health insurance. Depending on the life insurance plan, the policy *might* be convertible to a private policy, but it's NOT part of COBRA.
