Is lying about having a preexisting condition considered insurance fraud?
let's say I file a claim and they pay for the treatment. If my insurance finds out later through investigation, how much trouble could I actual get in for lying about a pre-existing condition.

Of course it is fraud, your contract will be void, and if they paid anything you need to repay it right away. Otherwise you have worse troubles then owing them money, you also have criminal charges to deal with. Insurance fraud is a felony.

There is a Yes & a NO to this.

Yes: If the lie is determined to be a material misrepresentation it is fraud. In that case your policy will be terminated and the insurer may seek reimbursement for any fees paid on your behalf (Although it may also deduct your premiums from the amount demanded).

NO: If the the lie is not determined to be a material misrepresentation it is not fraud. In other words, the insurer still would have given you coverage (and at the same rate) had it known about the condition prior to issuing the policy. No harm, no foul.

However, the insurer could still terminate your policy for cause just because you lied, material lie or not. This is a jurisictional issue. Many jurisdictions only allow the voiding of contracs based on material representations. I do not know all of the facts but it seems that you have made a material representation to the insurance company.

That IS the definition of insurance fraud. They're smarter than you because as soon as the claim goes in they're going to investigate and then you'll owe the entire bill.

Lying about ANYTHING, on an application, is fraud.

What happens when you file that claim, is that they do NOT pay for treatment - they investigate, discover the preexisting condition, and deny your claim.

Then, you get stuck with thousands and thousands in testing and treatment, and complain about the insurance company screwing YOU over, when in reality, you were trying to screw THEM over.

I think you don't realize how easy it is for the insurance company to find out you have a preexisting condition.

Yes it's fraud and grounds for rescission. You lose your insurance and you have to pay back any charges paid.

I believe this would be considered fraud and at the very least you would have to refund the monies paid
