Is my homeowners insurance or the associations insurance responsible for outside gas pipe and gas meter?
I live in a townhome and my gas meter and ballard post was hit by somebody who then took off resulting in damage to the gas pipe and the post blocking the gas pipe (ballard). My town home association says it is my responsibility to pay for these. I feel it is there responsibility because these damages are outside my actual house and therefore not covered by my townhome insurance. Who should be responsible for the repairs?

flipmodesb, Home insurance covers lots of different things. I don't understand all the details of my home policy, but my homeowners insurance agent is always a phone call away. If those item are a part of your home and not common area then it would be your responsibility and not the HOA.

you need to read your associations policy and regulations. this will tell you what exactly they cover and what you need to cover.

I would call your homeowners association and read the bylaws first. Then start calling insurance companies (yours and theirs). That's where you will get your straight answer. I would suspect that it's covered by the associations policy. Typically anything inside your walls is your responsibility. Anything outsideis theirs.

There were some pretty good answers, and some awful ones; but here you go.

First - Check the Association Bylaws & Agreements - there may be something in those documents; but unlikely. More than likely, you'll find something that says the association is responsible for the exterior walls, you are responsible for the interior walls, etc, etc. This can vary highly depending on the state, the age of the association, and how the original rules were set up.

I would speculate it would be the responsibility of your association.

That being said, you then need to go back and read more of the bylaws, and determine if the association will pay the entire cost (which they may), bill you for the entire cost (which is equally possbile), or bill everyone in the association (which is probably unlikely).

If the association pays, they will probably not turn it into their insurance. As someone else pointed out the association probably has a high deductible.

Now that all that is figured out, let's assume that the association charges you for the meter. Now you need to get out your insurance (not the insurance for the association) and find a section called "Loss Assesment". Your association is assesing a loss against you.

Some policies have specific clauses for loss assesments reducing or eliminating the deductible, or limiting the amount that will be paid. Your policy may or may not have anything regarding a loss assesment.

As clear as mud? Take these steps:

1) Contact the association - have them get the meter repaired.
2) Wait and see what happens.
3) If they asses you, contact your insurance company.
4) Wait and see what happens.

Possibly neither. Definately, your homeowners insurance doesn't pay for anything outside the wall. But likey, that association policy has a deductible of $25,000 or even more. You'd have to read your bylaws, to see what is YOUR responsibility, and what is theirs.

The responsible party, is the guy driving the car. But I think YOU are going to end up writing the check for the repair, unless you bought that insurance from the gas company every month.

Not everything that goes wrong, gets covered by insurance. Sometimes, you're out of pocket. Welcome to home ownership.
