Is the company responsible for stolen items?
A thousand dollars worth of my husband's tools were stolen out of his company van, while on company time. His company said they aren't obligated to replace nor reimburse him for those tools.

The company did not cause the tools to be stolen.

If a condition of your husbands employment is that he provide his own tools....then he will have to replace his tools as well.

Occasionally, a contractor's policy will provide some minimal coverage for employee tools but it sounds like the employer may not have that coverage. Try putting a claim in on your homeowners (or renters) coverage.

Sadly they are right. I know that when I was working in jobs I had to have my tools on site they wern't covered. Mine once were stolen out of a locked garage after hours, and the company claimed them and were paid but wouldn't ever reimburse me.

Yes, unless your husband has a contract with his employer that says differently, they are not responsible for HIS tools.

Your husband needs to file the claim under his inland marine policy, covering his business tools. If he has coverage.

Simply, if the property is yours then it is your duty to insure it unless you have worked out some type of arrangement with the company he works. The company would have a vested interest in your husband keeping his tools since he needs them to do his work. The company could take out insurance on the tools but if they dont it falls back on you since it is your property.

You would have some insurance coverage for business property that is away from your home under a renters or homeowners insurance policy. The coverage available for business property is greatly limited because business property is designed for a business policy so only small amounts of coverage are available under you homeowners or renters policy.

Finally if there is no insurance you need to make a list of the tools with prices and at the end of the year report the loss to the person who completes your taxes. It "may" give you some tax credit since it is a financial loss.
