Was in an accident a little over 2 years ago...late 20's, first ever accident. Not sure if observed as other parties fault, but I'm sure it was (they ran stop sign in NY). Did pt for 3 months plus, then was cut off b/c insurance co. said they would not pay any more. Diagnosed with a tear & disc bulges and surgery & medication was suggested on my back and knee. During pt, treatment helped momentarily, but pain would resurface within hours. Now, everyday I am in pain ranging from moderate to "just can't get up to go to work". Can't really drive any more as a line of work and before all this my health was pretty decent. Lawyer came to me with a figure a little over $7500. What the heck is that in comparison to my pain for the rest of my life? Definitely will not accept but I need some idea of what to ask for and what should I do with a lazy lawyer who barely had a 5 minute convo with me since taking my case. Thanks guys! Additional Details got a response from my crackhead lawyer. he thinks $$ "is as good as it's going to get". Can someone recommend a reputable lawyer or legal aid in NY City? |

Sorry about your situation...but some lawyers want a quick fix, so they can move on to their next victim. The figure that he quoted...was that before or after his cut? Sounds like the one you have is what is sometimes called an ambulance chaser. Does he want to parade you around in a neck brace and crutches that he keeps in his office? I don't mean to sound cold, but this is why the law profession doesn't get the respect it once did. Do research, ask questions, and by all means don't feel bad about giving your attorney the ol' heave ho! He (or she) is supposed to be working for you, not cutting deals with insurance companies behind your back! Ever hear of the term "civil suit"? Good luck. |

find another lawyer, you should be getting tons more. $7500 will not cover your future medical bills especially if you need surgery |

Any lawyer is OBLIGATED to present any settlement amount offered to you. He's not the guy that picks the amount, just the presenter.
Is this YOUR lawyer? Sounds like you're going to need one - you're going to be running up against the statue of limitations soon.
If you think your lawyer is lazy, get a new one. But usually stuff doesn't start happening until you get close to the time limit.
Ask your lawyer what he thinks it's worth.
Keep in mind two things: BC can put an attachment on the settlment amount to recover EVERY DIME they paid on your health insurance, towards these medical bills. So you need it to cover THAT much, at least. Also, the insurance company is NOT going to pay out more than the policy limit on their insured's policy. So if they have minimum liability - $15,000 in NY, that's the MOST the insurance company is going to offer. You'll have to refuse, sue the guy, and hope he's got money somewhere, or you won't ever get a dime, all you'll get is the JUDGEMENT. |

I got into a work related accident and used Jacoby & Meyers-although I'm getting a little less than what you got, so far at least-also FindLaw.org gave some good referrals..good luck!! Accidents are no fun..I can relate..I have 7 bulging discs and 2 herniated discs myself.. |

Man, what a creep! I'd dump him and get a better lawyer. See if you can get one with a LEgal Aid place. You have to think of how much money you would have made in your job, what you would have made in your job if you have to quit for health reasons, (Loss of Income) what medical bills you have and what the future ones are, (Health Care Costs as welll as Pain and Suffering) ,the stress incurred over this entire thing, plus the cost of the vehicle damage.
Consider inflation as well.
Depending on your age, you can figure out how many years of income you would have had from this job. They don't seem to care if you are retired as this means no income lost.
