I went to the doctor, and they asked if I had health insurance and I said yes but I wave the use of the insurance, months later I then receive a bill from an old insurance agency that I have not had in over four years, for that doctors visit. I did not give them any insurance information, I had insurance through my fathers work, and my mother takes care of the bills and did not want them to know of this visit. The bill IS from the insurance company, not from the doctor, I had to place the pieces together to figure out where it was from. I did not sign a paper waving the insurance, but i was willing to pay in full, then. Now i do not have the money due to loss of job. and I have current insurance, why would they use an old insurance that none of my family has used in over four years, instead of the current insurance. |

Why didn't they use the current insurance? Because, as you said, you didn't give them the insurance information.
They likely billed your old insurance company because they had the information on file for you. Its not illegal for them to do that. If there was a balance due for your services, then they had a right to try to collect payment.
You received an Explanation of Benefits (not a bill) "months later" from your old insurance company. My question is this: If you received services from the doctor that you planned to pay in full, then why did they even have to go to the trouble to locate insurance information from you? You should have paid the bill and been done with it.
If someone owed you money, wouldn't you make every effort to collect payment from whatever sources you had available? Of course. Had you paid for your services at the time of your visit, the doctor's office wouldn't have had to bother with searching for insurance information for you.
(And anyhow, it sounds pretty shady that your mom "didn't want your insurance company to know about your visit." Almost sounds like you're planning some sort of insurance fraud that it needs to be a big secret about.) |

They can't search for it. There isn't any mechanism to search for it.
But if you had gone there before WITH insurance, then likely the billing office would have submitted the bill to your insurance company, unless you paid in full at that time. The ONLY way they know that you have insurance, is if you give them the information. So if they then billed the insurance for a subsequent visit, it was likely an office error.
To avoid that in the future, pay in full, the charges, as you're leaving the office. |

I'm sort of confused as to WHY you waived the insurance...but that's your choice. I don't think it's illegal for them to search for it. If you didn't put it in writing that you didn't want to use it, then their billing department probably thought they were supposed to look for it for you.
As for getting a "bill" from another insurance company: they don't send bills. The thing the insurance company sends you is a statement. It's them telling you how much of your bill they are going to cover. In this case, since you don't have coverage from them any more, the statement probably says "You are covered for $0. You are responsible for this whole bill", which you will receive from the provider (the doctor).
If the only company they found in their "research" was one you don't have any more, I'm inclined to think you don't have insurance? In any event, you will be responsible for the whole bill from the doctor. You can probably just disregard the statement from the insurance company.
I think the doctors office was trying to help you. The insurance company they billed was probably in tehir records from a previous visit. If you have new insurance, that's what it's for--to pay for at least part of the bill. WHY ON EARTH would you pay a monthly premium for insurance and then not want to use it???? I WISH I had this problem...
Edit: I didn't say it wasn't from the insurance company. I said it wasn't a bill. It looks like a bill--I know cuz I get them all the time. It's a statement of benefits. All it says is the amount that you are responsible for. You DON'T PAY THEM. You only pay the dr.'s office. Disregard this statement. Call the dr.'s office and ask them for your balance. Then you can explain your financial situation to them and make payment arrangements.
If you've EVER used the old insurance company at this dr.'s office, it will stay in their records until YOU tell them to take it out and that you no longer have the policy. |

If you signed an informed consent form, and did not submit in writing that they could not bill insurance, then technically they can search for it. However, it does show poor practice on their part. I would file a formal complaint with their Privacy Officer. |
