Kitchen unit collapsed on me. Who's liable?
I live in a rented flat in London.

Last night, as I routinely opened the kitchen cupboards, the whole unit started to fall and nearly collapsed on me.

The unit is destroyed as with the glasses, plates etc.

As a tenant, whose reponsibile for the damages in this instance.

Surely there is a health and safety issue here if the kitchen unit just came apart by itself.

I have lived in the flat for around 4 months now, and up to now, the kitchen unit was fine.

Unless you routinely opened the cupboard by doing something stupid such as kicking it (which would make everything your fault), the landlord has to accept liability for the damage and any consequent loss to your items. The reason for this is that the cupboard will have been fixed to the wall which, in law, makes it part of the wall, which the landlord has a duty to maintain.

But, as has been already mentioned, raise the matter politely with your landlord and only mention section 11 of the Landlord & Tenant Act 1985 if you absolutely have to.

the collapse is evidently due to bad workmanship, the landlord is liable for the unit, and your injury.

You only have a contractual relationship with your landowner, who is the one you would turn to. They may, in turn, turn to the contractor they hired to install the cabinet, but it may have been one of their own staff. It is unlikely that the cabinet manufacturer did anything wrong.

For the physical damage of the flat, your landlord would be responsible. In most cases your property damage would be at your expense. The landlord should have dwelling insurance and you should have tenants insurance.

Most renter's fail to think about getting insurance for their belongings, but a dwelling policy for landlords will only cover the house not the contents.

Speak to the landlord/lady politley, don't lose your temper and check your tenancy, fixtures and fittings may be the responsibilty of the landlord but you must check.

Once happened to an ex of mine when the whole thing came off the wall!! the installers had missed every rawl plug by 3/4 inch!!!
We simply had them back out and they gave us cash for stuff broke. Your case is difficult probably? not knowing who installed it???
