OK the story is I just found out I've been paying mobile phone insurance for 6 years on a phone I only used for about 6 months after taking it out. It was through Threemobilephones (who are pants by the way, I've known that for ages, this is just typical of them), I must have been about 18 when I got the contract and must have ticked some box that said 'you definitely need insurance blah blah ours is really cheap blah blah' and signed a direct debit form for it. I then got the phone, and completely forgot about this pretty irrelevant insurance. They haven't sent anything to me since, any letter asking if I wanted to renew the insurance, reminders, anything even asking if I wanted to change it to a new phone or ANYTHING at all, they've just kept on charging me each month for 6 years - now I suddenly realise going through my statements theres one I can't think what it is, and find this out - they're saying since they didn't receive a letter from me asking to cancel they haven't cancelled it - simples...(for 6 years lol).

Can any lawyer or someone tell me - there must be something illegal in this, or at least a way I can force them to reimburse me for everything but the first year or something, when I was actually using the phone? Who the hell has ever used the same phone more than a year or 18 months? They can't pretend like they couldn't have worked that out, but yeah that doesnt in itself make it illegal...

OK rant over - I've been scammed in hundred of ways like this like most people probably, but this one is just taking the p....6 years lol.

Any lawyers and genius legal minds please reply:)

P.S. Mbrcatz as I said, they didn't send me a single thing - never had a letter, email, txt, anything INCLUDING statements (what would the statement be of anyway - its a single fixed monthly sum?)

don't waste time and money in taking legal actions. how much does the insurance cost you after 6 years? if they really did not send you renewal letter than there is definitely a clause for auto-renewal if not cancelled. go through the contract first. my feel is that you will not get anything out of it but you can try talking to the mobile company and get some compensation like voucher to at least subsidise a new phone. remember to use your status as loyal customer, it may help.

I don't think this is going to work. See, you HAD insurance for six years, and didn't use it. Just like, if you go six years without a claim on your auto insurance, you're not going to get your money back.

They sent you a statement every month, for six years - they told you 72 times you were paying for insurance. If you've asked nicely, and they won't reimburse you, I think you're screwed.

Cell phone insurance isn't TRUE insurance. It's more like a breakage warranty. It's not regulated by the insurance commissioner in your state, and no one needs a license to sell it.

It took you 6 years to figure this out??? The company did not do anything illegal, so goes to show that you need to read the fine print. You need to move on and just get over it. You were not screwed out of anything.

I think you'd need to get a copy of the contract you signed, esp. if you can't remember exactly what it said. You need to know that you are in the right before getting legal assistance.

Also, can you prove the phone was only in use for about 6 months?

This could get messy and expensive in court, especially since they'd have to dig through 6-year-old contracts and read through pages of fine print, checking signatures and whatnot, and signing the contract means you understand all that is entailed, whether you read it or not. Since you were 18 you are fully responsible for what happened, so pleading ignorance likely won't work.

Though I am not a lawyer, I don't really know everything, so I may be wrong, but this just seems like the case to me. Anyone else, feel free to correct me if I am wrong.
