NO...a Beneficiary should NEVER have to pay to receive the proceeds.
Insurance Companies are regulated by each specific state so I would definitely take this to the Insurance Commissioner's office. In addition, report this attorney to the state bar association for a possible ethics violation. Check if there has been any other complaints against this lawyer. If there isn't...file ONE!
Do know that Annuities DO NOT go through Probate. That's one of the things that makes Annuities a good investment as its death benefit is like a life insurance that bypasses probate so there is definitely no need for lawyers to file the claim. Depending on how much it is, if you wish, you may be able to hire your own lawyer for legal advice.
But once you find out what insurance company it is, as a beneficiary you will have some type of legal access to the policy.

In short, no you do not have to pay anybody.
Since you know your friend is dead, you should make a claim against the estate yourself and require the court to open the file to tell you who the insurer is.
Then you can make the annuity claim directly to the insurer yourself once you provide proof of death. (you'll need a copy of the death certificate).
You should then call the state's lawyer's discipline board and report the attorney. This is highly unethical. |

I believe this is unethical. Get his name and report him to the State Bar Association for unfair and unethical business practices. He could loose his practice because of it. See if that wakes him up.
THEN...
Sue him to give you the information. If he knows you are the beneficiary, then he knows who the carrier is as well and this was the intent of the deceased. Otherwise he would not know all of this information. If it is the intent of the deceased for you to have been the beneficiary, then the courts will make the attorney divulge the information otherwise he stands to be held in contempt of court.
Either way, he stands to loose his practice. |
