So here's my question in full: Is it legal for me to cash an insurance check made to myself (but intended for a third party's payment) for personal use? Could I then arrange monthly payments to fulfill my obligations to the third party? If not, I won't do it. Just can't find anyone who knows enough about it to help me. Thanks.

You should be aware that the healthcare provider will know that you received payment in full from the insurance company. They are notified that the claim "paid in full to the patient."
Technically, the provider could make payment arrangements with you. However, they may be less likely to do so knowing that you have already received payment in full.
I work for a large hospital system. When we discover that a patient received full payment from an insurance company but didn't bother to pay us, we don't mess around with payment arrangements...the account goes to collections/attorneys immediately, and 9 times out of 10 we end up with a court judgment against them and garnish their wages.
Its one thing to make payment arrangements with someone who has no access to any money...there are plenty of financial programs and payment plans available to people in those situations. But no one is obligated to work with you if you get the full payment and decide to spend it on something else. And really, can you blame them? You're basically stealing money from them.
You'll just end up digging yourself deeper in debt. If you're in a position to actually consider something like this, then you really need to evaluate your financial priorities - cut spending where you can and get yourself on more solid financial footing. Don't do something stupid to put yourself even further in the hole. Just my 2 cents. |

Yes, it is legal.
You sure could try to arrange monthly payments, which would likely include interest and service charges, but they are under no obligation to provide you with "financing". |

Yes-that is a legal option, however, I would inquire what arrangements could be made PRIOR to cashing the check. You may find that it is not possible or not a feasible option financially. |
