Of course. This is actually fairly common.
One policy will be primary according to industry standard Coordination of Benefit rules. And the other would be secondary.
Its not always necessary or beneficial to be on 2 policies. (For example, if the primary coverage picks up most of the bill, it doesn't always make sense to pay a premium for a secondary policy.)
Of course, in some instances, it might not cost any extra premium to have the child on 2 policies. For example, if your husband and his ex are both getting family coverage through an employer for their other dependents anyhow, it may not cost them any extra premium to stick their son on too.
My husband is covered on 2 health insurance policies - his own through his employer, and my family coverage through my employer. (He has to take the single coverage through his employer and doesn't pay any premiums for it. But, since I'm already paying for family coverage for me and the kids, I leave his name on my policy too. We don't pay any extra premiums for him to have the double coverage, so it makes sense in our case.) |

Sure, it's legal. One would be the primary carrier and one would be the secondary. Many people are covered by two (or more) policies. |

You can buy as many insurance policies as you'd like (although some companies require that you don't have other coverage), but it's just a waste of money. So, if she wants to give money away recommend that she give it to a nice charity instead. |
