just me | Litigation? |
Had a wreck. The offer came back and is too little. It would leave me in the whole, a 2500 bill becasue someone else hurt me. He was ticketed. They paid for the car. Now, my lawyer wants to go to litigation. The costs will go up from 1000 to 7500 and her % from 35 to 40. I am afraid of getting in debt even further. Never mind I also just got laid off for xmas, am behind on bills and have other med bills to pay!!!!!!!!!!!!!!! Additional Details She does not want money up front, but said we may have some out of pocket expenses in lititgation. |

You shouldn't have to pay a personal injury attorney anything upfront. Your attorney should work on a contingency basis and only gets paid if the case is resolved. There are a lot of attorney out there. |

That doesn't make sense. Why isn't your lawyer negotiating. You obviously have documentation for all out of pocket expenses and loss of wages. Also, you paid a retainer to the lawyer? Normally, a lawyer would wait until after a settlement to collect his 33%, not 35 to 40. It sounds like your attorney is ripping you off. I would call another attorney. |

You should find out from your attorney why he/she wants to file suit. Did the negotiations reach an impasse, or was the full policy offered and there is simply no more coverage available. Do you carry under-insured coverage on your policy? Tort attorneys usually do not require their clients to pay for their expenses up front. If this is really the case, consider finding another attorney. Do it before your current attorney files suit because he can then put a "lien" on any settlement to recover his costs/expenses. Also, unless the statute of limitations to file suit is about to run, ask your attorney to consider mediation and/or binding arbitration which is cost effective. Both parties usually split the expense. |

OK, the court isn't going to make the other guy pay any interest, or loan payoff or anything. THAT hole is your problem, from a bad financing deal.
Any medical bills paid by your auto insurance or health insurance, well, THEY get first dibs on any dollars you get.
If your lawyer won't do this on a no-win, no-fee basis, that means one of three things: 1. you don't have much of a case 2. the case isn't worth very much or 3. the other guy's insurance company is offering the polciy limit, which means that you likely won't get any more than that anyway, even if you get a JUDGEMENT for more (can't get blood from a stone).
In any case, once you agree to that 40% of take, sure you're going to be in the hole! Almost half of whatever you get goes to the lawyer! You're NOT going to get "plus lawyer fees" out of this.
I think your biggest mistake was hiring the lawyer, and it's going to cost you 35% of whatever you get - which WON'T be more than the policy limit. You hired the lawyer. Now you have to pay them. And yes, it's probably going to leave you in the hole, especially after the health and car insurance companies get their parts refunded. |

ask your lawyer to front you some money to tide you over. he can deduct it from your suit. i had the same thing happen to me. i was in a wreck with a lawyer. 99% of the time the other persons insurance company will settle with you and your lawyer before ever going to court. yes you have to compensate your attorney but you will come out with more money in the long run and you will have protection from your attorney go to court Good Luck! |
