If he uses your car more than once a month or more than ten times a year, you need to add him.
Or, if your policy has an exclusion for non-listed operators, you need to add him.

He needs to be listed as a driver under your policy. Notify your insurer immediately!

Your auto policy insures YOU for all the cars you own, and the occasional times you may let others drive your car. However, if he drives it regularly, you should add him to your policy as an additional driver. Otherwise your insurer may try to dispute a claim if he causes an accident & you said you were th eonly driver. He can only get his own policy in most states if he owns a car.
Doctor Deth
and have him pay any extra insurance you incur for adding him to your policy

i would add him to yours because if the car isnt in his name he cant get insurance in his name

It depends completely on your policy. Most full coverage policies from leading national Insurers, i.e. Statefarm, have clauses that cover any legal driver with your permission to borrow the vehicle. If he is a regular driver he will need to be added to the policy but occasional borrowing is fine. Again, you would have to read over your policy or contact your agent to find out the specifics of your policy.

Contact your insurance agent and find out if you have second driver coverage (in many states it is required) and you can also ask them to quote you for adding him by name as well as an independent policy for him. In either case your brother should chip in for the insurance. Good Luck!
